Job Description
Working as a Director of the Commercial Management Department, you will address commercial aspects of large EPC, mid-cap, Consulting and Engineering Services Agreement pursuits for Zachry with primary focus on managing commercial risk and maximizing profitability revenue growth of Zachry under all contracts with customers and partners.
You will have responsibilities that include development of strategy and structure for any key joint venture partners, consortium partners, key subcontractors, including any internal Zachry affiliates (Zachry Engineering, JVIC, etc.). Chair and facilitate the Deal Architecture Process to seek out input from all subject matter experts needed to present cohesive and effective proposals to customers. Ability to negotiate and take the lead in discussing key commercial issues when negotiating with partners and customers.
Responsibilities
What you'll do as a Director of Commercial Management
• Work closely with any business development, legal, proposals leadership, project leadership, and other project team members to lead Zachry in the development and negotiation of contracts with customers and partners, including conducting risk assessments and facilitating other commercial matters and documentation.
• Collaborating with all support functions and ensuring conformance with Zachry's Deal Architecture process is maintained.
• Develop and negotiate into customer and partner contracts robust commercial processes for the management of changes.
• Develop and negotiate into customer and partner contract robust commercial processes for the management of commercial liabilities and risk in relation to current and changing market conditions.
• Work collaboratively with other Zachry managers and functional support (Legal/Risk, Accounting, JV Administration, Estimating, and Contract Management, etc.) to lead Zachry's interests in all customer contract development and negotiation.
• Work closely with Legal and Risk Department in administering commercial requirements of insurance program and other commercial project content.
• Develop contracting and negotiation strategies to support current and developing market conditions.
• Provide reports on progress of negotiations to Executive Management through regular governance protocols associated with the Deal Architecture Process.
• Develop and negotiate partnership agreements to support associated Engineering, Construction and Procurement; Consulting Services; and Engineering Services Agreements, as applicable.
• Reports to Vice President of Commercial Management Department.
Qualifications
What you'll need:
• 10+ years of relevant large EPC project experience a must
• Minimum of Bachelor of engineering, construction management, or other technical degree required.
• Proven effective written and verbal communication skills while working in an international, multi-cultural team environment.
• Proven negotiation skills and successes a must
• Knowledge of EPC Contracting and Partnership Contracting strategies, document management, scheduling, advanced work packaging (AWP) and cost management techniques for major EPC projects and Consulting and Engineering Services Agreements needed.
• Contract management, change management and administration experience.
• Minimum of 5 years experience with field project management and execution of large EPC Projects a must.
• Proven experience with early impact identification and calculation techniques for major EPC projects, development of mitigation strategies, and negotiating the inclusion of provisions to protect Zachry during the contract negotiation phase.
• Forward-looking, proactive, self-motivated approach to work with an ability to work independently and as part of matrixed teams with minimal supervision
• Some international and domestic travel required
• Proactive ownership of the work a must
• Occasional nights and weekends required to meet deadlines.
What is an added plus?
• Advanced management degree preferred, but optional depending on past experience with business administration and financial management.
PHYSICAL DEMANDS
Employee will be required to communicate in person, via telephone, email, use of arm/hand steadiness, manual dexterity, finger dexterity, multi limb coordination, oral expression, and comprehension. May be required to lift, carry and move objects safely.
WORK ENVIRONMENT
Work will be in a conservative corporate office environment operating and functioning at a fast pace. Working out of cubicles near other various colleagues who are also in cubes. Some may refer to these workspaces as cube farms. Our corporate campus includes an on-site café with various daily breakfast, lunch and snack-time selections, a sizeable fitness center equipped with various state of the art work out equipment & weights, outdoor walking/jogging-path, herb garden, basketball half-court, sand-volley ball court, and soccer field. Office noise will be low and generally consist of cube neighbors' phone-calls, conversations and/or laughter.
