Dow has an exciting opportunity for an eDiscovery Attorney located in Midland, MI!

In this role, you will provide legal oversight of discovery in litigation, investigations, regulatory matters, and other legal proceedings. Working with Discovery & Knowledge Management professionals, case management teams, other Legal department professionals, information technology personnel, outside counsel, and vendors, you will develop legally defensible, cost-effective, and proportionate discovery strategies that use established and emerging technologies to address evolving legal and business needs. You will independently advise case teams on complex preservation, collection, review, privilege, and production issues; lead internal and external projects with manageable risks and resource requirements; and exercise judgment in evaluating information, selecting solutions, and building consensus on difficult or sensitive issues. You will also help enhance internal capabilities and serve as a resource for less experienced colleagues while working independently with minimal guidance.

Responsibilities

• Oversee the development and maintenance of effective in-house eDiscovery capabilities that comply with applicable laws, rules of civil procedure, and court rules, including through process and workflow documents covering topics such as legal hold creation and discovery collection, preservation, review for responsiveness and privilege, and production.  

• Assist with provision of legal training and education on legal holds and discovery obligations, evidence preservation, defensible workflows, legal privilege, and the appropriate use of emerging technologies. 

• Evaluate new matters to identify preservation and discovery obligations and advise case management teams on appropriate next steps, including creation of legal holds. Assess proportionality, legal risk, cost, and defensibility when selecting preservation, collection, review, and production approaches. 

• Support case management teams by reviewing and drafting legal documents, including summaries and analyses of complaints, answers, discovery requests and responses, motions, and documents collected in discovery. 

• Work with outside counsel and vendors to efficiently satisfy discovery obligations, applying consistent, risk-based methodologies across matters supported in-house, through hybrid teams, or by outside counsel. 
• Collaborate with internal legal subject matter experts and other Company resources; advise case management teams on discovery positions, proposed protocols, negotiations, and issues requiring escalation; and direct paralegals, review teams, and other support staff. 

• Building, evaluating, or using emerging technology to enhance internal eDiscovery capabilities, lower costs, and improve efficiency.   

Required Qualifications

• Juris Doctor or Master of Laws.

• A minimum of 2 years practicing law.

• Experience with electronic discovery review platforms.

• Strong familiarity with the Federal Rules of Civil Procedure and/or State Rules of Civil Procedure.

• Admission to and in good standing in a State Bar or eligible for admission.

• A minimum requirement for this U.S.-based position is the ability to work legally in the United States.  No visa sponsorship/support is available for this position, including for any type of U.S. permanent residency (green card) process.

Preferred Qualifications

• Strong law school credentials.

• 3+ years’ demonstrable competence practicing law with a major law firm or corporation as an in-house counsel or general practitioner.

• Educational background in computer science, information technology, or related fields.

• Strong negotiation and communication skills (written and oral).

• The ability to deal efficiently with time-sensitive demands from a variety of clients.
