Full Job Description
Provides training programs to hospital staff, physicians, and board members on regulatory requirements for hospitals and physicians. Performs other duties as assigned. Works with Corporate Responsibility and Compliance Directors on internal investigations and regulatory reporting. Prepares legal documents involving analysis, legal research, and application of legal expertise and transactional experience. Analyzes client inquiries and holds regular status meetings with Regional CEO and hospital executives. Attends client meetings to provide legal advice and necessary documents. Serves as primary legal counsel for hospitals and affiliated entities, providing guidance on transactional, regulatory matters, joint ventures, corporate structures, medical staff credentialing issues, and peer review. Advises hospital administration and Boards of Directors on all legal matters, including compliance with federal and state law, and Joint Commission Standards. Supervises legal aspects of acquisitions, co-management agreements, joint ventures, and formation of physician-hospital networks. Counsels on legal issues related to medical staff bylaws, disciplinary action, peer review, and EMTALA, including drafting medical staff policies, rules, and regulations, and attending medical staff meetings. Collaborates with risk management and nursing staff on inquiries related to patient rights, guardianships, informed consent issues, and advanced directives. Reviews clinical trial contracts, corporate transactions, purchase agreements, and real estate transactions. Provides legal advice to not-for-profit hospital foundations.
Knowledge, Skills, and Abilities:
Ability to think logically and possess a strong affinity for hospital operations and the goals of the Client as they relate to the organization as a whole. [Required]
Knowledge of health care law, including general principles of Medicare reimbursement programs, anti-fraud statutes and programs including the Medicare Fraud and Abuse (Anti-Kickback) Statute, Stark Rules, False Claims Act, and Civil Monetary Penalty Act. [Required]
Knowledge of federal and state tax law, real estate law, tort law, hospital and physician licensure law and contract law as those areas relate to health care law. [Required]
Strong analytical abilities and be able to work effectively under strict time constraints. [Required]
Strong written and oral communication skills with the ability to interact well with people from various levels within the organization. [Required]
Legal research skills. [Required]
Comprehensive knowledge of legal publications and the ability to use them efficiently including computer-assisted research by using on-line services. [Required]
Ability to reason analytically and pragmatically. [Required]
Ability to grasp, comprehend and analyze complex legal issues and complicated factual details. [Required]
Ability to work effectively with others as well as work independently, without close supervision. [Required]
Familiarity with Microsoft's office suite, email applications, and other software resources. [Required]
Specific experience in hospital regulatory compliance in the areas of fraud and abuse, anti-referral laws, peer review, patient rights, federal privacy laws, and research involving human subjects. [Preferred
Experience in acquisition of hospitals, ambulatory surgery centers, physician practices, and medical practices. [Preferred]
Teaching and public speaking ability. [Preferred]
Experience with mental health, emergency services, surgical services, and various inpatient and outpatient services. [Preferred]
Ability to negotiate with opposing counsel on contractual matters, medical staff issues, and litigation matters. [Preferred]
Knowledge of tax-exempt hospital foundation regulations. [Preferred]
Experience with academic affiliations. [Preferred]
Education:
Doctorate [Required]
Work Experience:
Hospital in-house counsel experience. [Preferred]
Law firm experience. [Preferred]

Pay Range:
$225,721.60 - $451,464.00
