Manager V General Description. Under the direction of the Regional Director (RD), this position performs complex managerial work as an Assistant Regional Director for Health Facility Compliance (HFC) in the Health Care Regulation (HCR) department of the Regulatory Services Division at the Texas Health and Human Services Commission (HHSC). This position administers daily operations and activities related to the regulation of licensed and certified health care facilities in Texas. Regulated facilities for this position include, but are not limited to, general and special hospitals, psychiatric hospitals, ambulatory surgical centers, end-stage renal disease (dialysis) facilities, special care facilities, birthing centers, and abortion facilities (legal), freestanding emergency medical centers, rural health clinics, and community mental health centers. The work involves assisting in establishing program goals and objectives; developing guidelines, procedures, policies, rules, and regulations; hiring and training staff; developing work schedules, priorities, and standards for achieving established statewide goals; and coordinating and evaluating state and federal workload targets. Plans, assigns, and monitors the work of regional Surveyor staff. Works under general supervision, with moderate latitude for the use of initiative and independent judgment.
Essential Job Functions:
EJF #1, 30%: Oversees the scheduling of the work of the health facility compliance staff in the assigned region. Monitors the state and federal activities of professional staff related to the regulation of licensed and certified health care facilities in Texas. Evaluates facilities' plans of correction for acceptability based on the CMS State Operations Manual (SOM) and established state standards. Ensures reports set for state and federal enforcement are also reviewed by the RD. Continuously monitors the state and federal workload databases, ASPEN and TULIP, for timeliness and completion of regional staff workload assignments. Assists the RD and Health Facility Compliance Director in establishing statewide goals and objectives consistent with the federal Centers for Medicare & Medicaid Services Mission and Priority document and the CLIA budget call letter that establish workload priorities for health facility compliance. Develops and approves schedules, priorities, and standards for achieving workload goals through complex and coordinated communication among other ARDs and RDs. Manages ongoing evaluation activities to determine completion of state or federal surveys of health facilities and coordinates efforts with other ARDs and RDs.
EJF #2, 20%: Supervises and monitors the work of the health facility compliance administrative staff assigned to the region. Works collaboratively with administrative staff in processing licensure and Medicare certification kits and makes recommendations to the RD to improve survey and administrative operations. Oversees the preparation of management and productivity workload reports. Routes supply orders as necessary for staff. Uses CAPPS to interview, select, and hire staff; approves staff time and leave; performs staff performance coaching and evaluations; and recommends merits, administrative leave awards, and disciplinary actions in accordance with department policy. Reviews and approves staff travel requests and travel vouchers.
EJF #3, 20%: Assists the RD in developing and implementing methods for evaluating the program's state, and CMS compliance activities across the state, including coordinating the region's quality assurance activities consistent with the CMS Texas State Performance Standards System (SPSS), and activities related to workload completion and use of the state Regulatory Automated System (RAS/VERSA) and federal ASPEN (ACO/ACTS) databases. Each ARD communicates and coordinates workload activities in conjunction with the process maintained by the HFC quality assurance coordinator for statewide monitoring. Monitors and makes recommendations for the SPSS reports and implementation of the SPSS plan of correction, if needed. Ensures compliance with agency and departmental policies and procedures.
EJF #4, 10%: Contributes to the statewide accomplishment of HFC-assigned workload by participating in ongoing compliance activity. Periodically conducts on-site surveys and investigations of licensed or Medicare-certified health care facilities to determine compliance with applicable state and federal laws, regulations, and rules. Leads survey teams on large surveys requiring complex coordination of staff from multiple regions.
EJF #5, 10%: Works collaboratively with survey staff on the preparation of enforcement referral packets for state enforcement and provides technical guidance to enforcement staff, including presenting complex cases to the Enforcement Review Committee for consideration. Works collaboratively with the RD to evaluate and recommend federal termination actions for Medicare to CMS, as appropriate. Ensures timely submission and follow-up of enforcement recommendations and provides briefings to senior-level and executive management regarding federal and state enforcement actions.
EJF #6, 5%: Oversees mentoring and precepting of new survey staff and coordinates the training of new surveyors with HFC surveyors and the HCR training team. Works in conjunction with the RD to orient new staff members and ensures completion of required training. Assist in determining whether staff in training are ready to work independently. Coordinates with the RD for periodic monitoring and evaluation of on-site survey activity by survey staff.
EJF #7, 5%: Performs other duties as assigned. Other assigned duties include, but are not limited to, actively participating in or serving in a supporting role to meet the agency's obligations for disaster response, recovery, or continuity of operations plan activation. Such participation may require an alternate shift pattern or work location.

Registration or Licensure Requirements:
Preferred: Texas-licensed RN, BSN, LMSW, MHA, or MPH degree, or certification in a related field.
Initial Selection Criteria:
Graduation from an accredited four-year college or university with major coursework in a field relevant to the assignment is generally preferred. Experience and education may be substituted for one another. Regulatory experience required. Management or supervisory experience preferred.
