Full Job Description
Under the supervision of the Commercial Director - Design Agreements, the incumbent is responsible for the administrative management related to the preparation and implementation of professional services agreements (architecture, engineering, and specialized services) for Pomerleau's projects, throughout both the proposal phase and the project execution phase. What you will do • Participate to consultants' selection process by preparing the statement of qualifications, evaluating consultants' responses and organizing interviews, etc. • Prepare, review, and negotiate different consultant contracts with architects, engineers and specialty consultants for various project delivery models including design-build, progressive design-build, and integrated project delivery • In collaboration with the legal team and bid managers analyze the risks associated with the various design agreements to align with the terms and risk profile of the prime contract between the design-builder and the client • Work closely with design managers, legal counsel, insurance specialists, project managers, and preconstruction and construction leads to ensure contract strategies support project delivery and corporate policies • Collaborate with design managers and bid managers to define, develop, and finalize scopes of work and design schedules for the RFP and execution phases to ensure alignment with project requirements and timely execution of contracts • Support the negotiation of consultant fees and related commercial terms, including payment milestones, holdbacks, and payment schedules • Maintain and develop standard contract templates tailored to various project phases and delivery modes • Manage the internal contract approval processes and ensure all agreements are compliant with company standards and legal requirements • Provide contract interpretation and support to project teams during contract execution and dispute resolution • Contribute to the ongoing improvement of contract management tools, processes, and templates to support efficiency and consistency across projects. • Maintain strong relations with the engineering and architecture consultants • Convey a positive and consistent image of Pomerleau and its values to stakeholders • Participate in ensuring the integrity of the process and foster positive internal and external relations. This role could be for you if you have • Post-secondary education in engineering, law, or equivalent • 7+ years of experience in contract management within the construction or engineering sectors, for building and/or infrastructure projects (experience in both building and infrastructure is an asset) • English and French necessary • Experience working in a design-builder or engineering firms • Strong understanding of alternative delivery mode projects (P3, design-build), or related experience • Strong understanding of public procurement processes and policies, and proposal processes • Strong understanding of various contractual and commercial concepts and their interrelations, such as liquidated damages, liability caps, indemnity clauses, payment terms, intellectual property rights, insurance requirements, and change management provisions. • Excellent negotiation skills and strong communication skills, both verbal and written • Advanced technical skills in MS Word, MS Project, Excel and PowerPoint • Strong sense of initiative and ability to work independently as well as collaborate successfully in a team environment • Superior organizational and project management skills with a proven ability to manage multiple priorities and projects to completion • Ability to self-manage a project or a process and complete tasks with minimal supervision • Ability to adapt to varied schedules in a work environment with tight deadlines • Conscientious with great attention to detail • Available to travel across the country on an occasional basis Benefits • RRSP with up to 5% employer matching • Hybrid work model for corporate roles • Employee stock ownership program • Career growth through real development opportunities • Transit pass reimbursement - get to work for free • Minimum 4 weeks of vacation from day one The expected compensation range posted for this role applies to available work locations in Ontario and/or British Columbia.
