Position Description

Position Summary

This role performs advanced to highly advanced (senior level) legal work for the Office of the General Counsel. Work involves planning and implementing legal tasks, preparing and reviewing legal documents, interpreting laws and regulations, rendering legal advice and counsel, and providing internal and external training on matters relevant to the agency. This role will also support the agency's privacy and AI governance programs and may collaborate with senior leaders to promote activities that foster a culture awareness around ethical AI and privacy. Works under minimal supervision with considerable to extensive latitude for the use of initiative and independent judgment.
• Researches, reviews, and interprets laws and regulations relevant to the agency, including issues related to procurement, privacy, rulemaking, security, and open records, and advises staff on their application and impact to the agency.
• Reviews, analyses, and consults on pending legislation; prepares bill analysis and fiscal notes; consults with internal and external stakeholders regarding legislation relevant to the agency.
• Monitors active litigation and other actions involving the agency, including matters handled by OAG or outside counsel, and serves as liaison between agency staff and litigation counsel, ensuring timely communication, document production, and issue tracking.
• Supports the agency privacy and AI governance programs by providing legal advice, guidance, and training on privacy and ethical AI best practices and by assisting in the management of legal compliance and incident response
• Reviews, revises, and drafts complex contracts, including technology and license agreements; reviews, revises, and drafts interagency contracts, inter-local contracts, and memoranda of understanding; negotiates with vendors or agency representatives regarding contract terms.
• Provides educational outreach and training to agency staff and other governmental entities regarding areas of law relevant to the agency, such as privacy, artificial intelligence, ethics, open government, and procurement.
• Serves as an assistant ethics officer for the agency by providing advice and counsel to agency staff and Board,
• Performs other work-related duties as assigned.

Qualifications:

Education
• Graduation from an accredited law school with an LL.B. or a J.D. degree
• Must be licensed to practice law in the state of Texas.

Experience and Training Required
• Licensed and in good standing with the State Bar of Texas with a minimum of seven (7) years of experience as a practicing attorney.

Experience and Training Preferred
• Extensive experience in advising a governmental entity on the application of federal and state laws affecting Texas agency operations and administration of agency policies, regulations, and procedures
• Experience with administrative rulemaking
• Experience with analyzing, implementing, and ensuring compliance with legislation or regulation
• Experience in litigation and civil procedure
• Familiarity with privacy laws, incident response protocols, and best practices
• Familiarity with artificial intelligence governance and best practices
• Familiarity drafting and revising information technology contracts
• Familiarity with applicable information technology laws and regulations

Knowledge, Skills, and Abilities
• Knowledge of Texas state government, state legislative processes, and the state budget process
• Knowledge of risk assessment and development of privacy breach reporting systems and protocols
• Excellent skill in communicating both verbally and in writing, in a clear and concise manner.

• Demonstrated ability to communicate with people of diverse backgrounds and organizational levels.
