Job Summary:

The Associate General Counsel provides departmental and corporate management oversight, legal review, commercial contracting, strategic transactions of general corporate matters, and advice and support of on-going litigation, claims and risk management insurance defense.

Our ideal candidate will possess depth and expertise in litigation, contracts and contract negotiations, various insurance and risk management matters, claims management, commercial general and auto liability insurance defense, workers' compensation and non-subscriber workplace injury claims. This role requires critical analysis skills, and an understanding of the relationship of the organization, vendor partners and customers. This role will require direct management in the day-to-day management of McCoy's insurance programs, providing insurance support and advice to operational and support teams and ensuring that McCoy's responsibly manages business and operational risk through effective claims prevention, investigation, management, and resolution.

Duties/Responsibilities:
  • Manages oversight and guidance to outside counsel on a wide variety of litigated matters.
  • Oversees the procurement and management of the Company's lines of insurance, including general liability, commercial auto liability, workers' compensation and employee work injury plans, property, umbrella, excess, and other lines of coverage.
  • Leads the development, implementation, and ongoing management of in-house commercial general liability claims administration processes.
  • Coordinates annual insurance renewal process, including working with internal management and insurance broker on information gathering and coverage requirements and application.
  • Oversees the Company's insurance program, including annual renewals, procurement, policy review, endorsements, coverage analysis, and compliance with contractual insurance requirements while identifying coverage gaps and recommending appropriate risk transfer solutions. [MR1.1]
  • Monitors any remediation progress and provides regular claim status updates to operational leaders.
  • Coordinates and implements risk and insurance process improvements to reduce high-touch practices and streamline processes.
  • Manages, tracks and monitors potential exposure and resolution of auto and property claims in conjunction with McCoy's safety team including investigation, fact gathering, and reporting of all incidents to the appropriate parties while proactively administering the claim adjudication and resolution process with the carrier and outside counsel in conjunction with the SVP/General Counsel.
  • Develops and delivers training programs for operational and supports teams on insurance, claims management, contractual risk transfer, and legal risk mitigation.
  • Performs other duties as assigned by Senior Management.
  • Reviews and updates corporate policies and procedures to ensure compliance with applicable laws, regulatory requirements, and evolving business needs while providing guidance and training to company personnel and third-party partners.
  • Actively assists business units related to contract review and development. Assists in the determination of potential legal exposures and potential litigation related to commercial general liability, automobile liability, and employee/labor related matters.
  • Serves as a strategic legal advisor on complex commercial, compliance, litigation, and corporate matters involving significant legal or financial risk.
  • Attends team meetings, training sessions, and professional development activities.
  • Other assignments and duties as assigned by management.


Required Skills/Abilities:
  • High degree of professional ethics and integrity.
  • Excellent judgment and ability to operate in a fast-paced, small legal department on a broad range of commercial and legal matters with a primary focus on managing litigation and negotiating complex contractual arrangements with customers and vendors.
  • Ability to act independently and as part of a team. Ability to provide solution-oriented, practical guidance in working with business management.
  • Outstanding verbal and written communication skills and ability to communicate clearly with colleagues, outside counsel, business partners, and other stakeholders. Excellent analytical skills and people skills are essential.
  • Ability to prioritize responsibilities, to work efficiently, to manage, and to conclude, in a timely manner, many agreements, projects, and issues.
  • Willingness to travel and work extended hours, as needed.
  • Demonstrated ability to balance legal risk with practical business objectives while building strong relationships across all levels of the company.
  • Position requires periodic overnight travel.
  • Must have a current driver's license and auto liability insurance.


Education/Experience
  • Juris Doctorate (JD) degree from an accredited law school.
  • Admission and membership in good standing to the bar of the State of Texas.
  • 5+ years of experience and practical skills in litigation/commercial transactional/contracting matters.
  • Experience managing commercial insurance programs.
  • Experience with Texas non-subscriber workplace injury programs.
  • Experience supervising outside counsel.
  • Experience negotiating commercial contracts.
  • Experience advising executive leadership.
  • Experience with construction, manufacturing, distribution, retail, or transportation industries.
  • Microsoft Office (Word, Excel, and PowerPoint) Microsoft Teams, Zoom, and IBM Cognos experience.


Physical Requirements
  • Prolonged periods sitting at a desk and working on a computer.
  • Must be able to frequently lift and/or move 25 pounds may be occasionally required to lift up to 50 lbs.
  • Specific vision abilities required by this job include close vision.
  • Standard office hours apply with occasional weekends and holidays.
  • Must be regularly available and willing to work on average 40 hours per week during business hours or as the employer determines are necessary or desirable to meet business needs.
  • Primarily office environment with regular travel to stores and community events. Moderate noise levels are typical.
  • The noise level in the work environment is usually moderate.
