Duties Description This position is assigned to the Bureau of Adjudication in the Department of Health's Division of Legal Affairs (DLA).
The Bureau of Adjudication is an extremely active Bureau within DLA; annually handling and/or conducting administrative hearings on several hundred cases, hearings, and appeals. The Bureau consists of approximately fourteen professional and paraprofessional legal staff.
The Chief Administrative Law Judge manages the day-to-day operations of the Bureau, oversees the Department of Health's administrative hearing processes, and supervises all professional, paraprofessional, and clerical support staff of the Bureau. The current Chief also conducts hearings as an Administrative Law Judge in all Department hearings and appeals and is an ex-officio member of the Advisory Board to the Board of Professional Medical Conduct.
Other additional duties and responsibilities will be assigned as necessary to meet the Department's and Bureau's needs and objectives.
Minimum Qualifications Law degree from an accredited law school; admission to, and member in good standing, of the New York State Bar; and 8 years of relevant post-bar experience.
Preferred Qualifications: The preferred candidate will have knowledge and experience of the Department of Health's administrative hearing system under the Public Health Law, Social Services Law, Elder Law and the pertinent regulations in titles 10 and 18 NYCRR and title 7 CFR. Candidates will also have experience serving as an Administrative Law Judge, possess strong legal skills, impeccable judgment; and be committed to working to advance the priorities of the NYS Department of Health. Demonstrable supervisory experience is essential as the position requires the management of a bureau with approximately eleven professionals who function as hearing examiners, administrative officers, administrative tribunal representatives, hearing officers and administrative law judges.
