SUMMARY

Under general supervision, guides MPS staff on MPS due process compliance with special education laws and regulations and District rules and procedures; analyzes and reviews due process compliance issues and agreements.

Essential duties and responsibilities may include, but are not limited to, the following:

  • Provides advice and guidance to MPS teaching and administrative staff on MPS due process compliance with special education laws and regulations, and District rules and procedures.
  • Assists MPS staff with special education student issues and decisions on compliance with Individualized Education Program (IEP) documentation; assists with legal issues and documents for due process proceedings and disciplinary actions.
  • Facilitates communications with MPS staff and families of students; assures the consistent interpretation and application of state and federal regulations and MPS policies.
  • Compiles and analyzes information from a variety of sources, and prepares written responses to Minnesota Department of Education (MDE); assists with implementation of corrective actions required by MDE, and monitors status of corrective actions.
  • Facilitates and coordinates conciliation conferences and mediations involving disputes between MPS and students/families regarding special education services.
  • Prepares and presents training for Special Education (SE) department staff on legal, technical and compliance issues.
  • Monitors and reviews case files to assure compliance with state and federal laws; maintains and updates Due Process Notebook as needed.
  • Responds to records requests according to Department of Justice (DOJ) Freedom of Information Act (FOIA) standards; assists outside counsel as directed.
  • Exercises independent judgment and resolves issues within MPS policy guidelines.
  • Supports the relationship between MPS and the community by demonstrating courteous and cooperative behavior when interacting with students, clients, visitors, and MPS staff; enthusiastically promotes the Superintendent's goals and priorities in compliance with all policies and procedures.
  • Maintains absolute confidentiality of work-related issues, records and MPS information.


MINIMUM QUALIFICATIONS

Education, Training and Experience Guidelines
  • Current Minnesota School Social Worker license, or current Minnesota School Psychologist license, or current Minnesota Special Education Teacher license;
  • At least three years of experience as a school social worker, special education teacher, or school psychologist for Minneapolis Public Schools or other public school system OR an equivalent combination of education, training and experience as determined by Human Resources.


Knowledge of:
  • Minnesota rules and applicable Federal rules and regulations governing public education and data privacy.
  • State and Federal laws and regulatory issues governing SE Programs in public education, including rules and regulations of the Minnesota Department of Education and other governing agencies.


Skill in:
  • Exercising judgment and discretion in mediating difficult situations.
  • Researching, collecting, analyzing, and preparing data, and generating reports.
  • Establishing and maintaining effective working relationships with co-workers, community leaders, government agency representatives, and the public.
  • Operating a personal computer utilizing standard and specialized software.
  • Communicating effectively orally and in writing.


LICENSE AND CERTIFICATION REQUIREMENTS

A valid Minnesota State Driver's License may be required.

PHYSICAL DEMANDS AND WORKING ENVIRONMENT

Work is performed in a standard office environment which requires occasionally lifting such articles as file boxes or heavier materials with help from others and/or lifting and carrying light objects frequently. A job in this category may require walking or standing to a significant degree or may involve sitting most of the time with long periods of computer work and heavy phone usage.
