Job Description:Role Overview & Key Responsibilities:The Senior Counsel, Secured Recovery, is responsible for supporting recovery of mortgages and other secured lending products, as well as providing strategic and legal advice to the business on such matters.
This role requires strong judgment, the ability to navigate ambiguity, and a focus on enabling business outcomes within TD's risk appetite. The successful candidate will work closely with Customer Assistance- Mortgage Recovery Unit and other risk partners and stakeholders to support secured recovery portfolio across Canada. You will:
- Provide risk-calibrated legal advice that enables business strategy while managing legal risk
- Deliver clear and direct guidance, including on sensitive or high-risk matters
- Translate complex legal issues into clear, practical guidance for business partners
- Influence decision-making in complex and ambiguous situations
- Identify emerging risks, regulatory developments, and industry trends, and proactively advise on impacts
- Build strong, trusted relationships with senior stakeholders across Legal, Risk, and the business
- Support and mentor other counsel; contribute to team development and culture
- Drive innovation in legal processes, including leveraging technology and new ways of working (e.g., co-pilot)
Core Accountabilities:- Act as a subject matter expert in secured product recovery and mortgage-related legal frameworks
- Provide advice on reputational risk, litigation and disclosure issues for Canada wide enforcement files
- Provide legal advice, support and oversight for the Customer Assistance business and control partners in secured recoveries, projects, initiatives, and litigation.
- Manage all issues relating to TD's portfolio of real estate secured enforcement in Ontario including carriage of real estate secured enforcement files, managing external counsel, title issues, and real estate sales within mortgage enforcement process.
- Outside of Ontario, assist the business in managing external counsel and escalations, including approving budgets and billing
- Provide direction and guidance to law clerks and legal assistants handling secured product recovery matters
- Provide advice to other members of the Legal Department and businesses across TD with respect to contractual interpretation and drafting, pre-litigation dispute resolution and litigation risk analysis with respect to secured product recovery.
- Provide guidance on processes and documentation as the collections processes evolve, with a focus on regulatory and statutory compliance.
- Provide guidance and advice to Customer Assistance regarding external vendor contracts.
- Strengthen stakeholder engagement and drive alignment across functions
- Serve as a source of expert advice to senior management in field of specialty; may lead team(s) of related specialists/experts
- Provide leadership guidance, make recommendations and collaborate with business to ensure solutions meets the business needs on a complex project or program
- Build and maintain positive working relationships by effectively communicating and regularly sharing information, learnings, and knowledge with internal and external business partners and external stakeholders
Qualifications:- Undergraduate degree or relevant professional certifications, designations, or equivalent required (JD/LLB)
- Admission to the Bar in good standing and licensed to practice law in Canada
- 8+ years relevant experience
Skills & Competencies:- Well-developed understanding of the Mortgages Act, the Land Titles Act, the Residential Tenancies Act, Teraview, title insurance, real estate conveyancing, Power of Sale & Foreclosure process, and real estate enforcement litigation in Ontario
- Strong business judgment with a solutions-oriented mindset
