Full Job Description
Overview

We are seeking a full-time Senior Counsel at Garmin's U.S. headquarters in the Greater Kansas City area. In this role, you will be responsible for leveraging legal subject matter knowledge in providing guidance on all related matters, projects, and litigation.

Essential Functions
  • Analyze and solve complex legal problems
  • Manage outside counsel effectively
  • Subject matter expert in one or more specific disciplines
  • Research applicable laws, regulations and rulings
  • Prepare and review contracts and other legal documents
  • Obtain and analyze all relevant information in order to advise on and provide accurate legal advice
  • Develop creative solutions to problems
  • Develop constructive and cooperative working relationships with other members of the Legal Department and with members of other Garmin departments

ESSENTIAL FUNCTIONS FOR SPECIFIC FOCUS AREAS:

Employment:
  • Provide support and advice to US, Canadian, Australian, and New Zealand Human Resources departments and management teams, including international outside counsel, on labor and employment law compliance
  • Provide support and advice to the Human Resources departments on complex leave issues, unemployment and worker's compensation claims, associate discipline and discharge decisions
  • Provide support and guidance on employment law, including handling complex issues involving but not limited to FLSA, FMLA, ADA, Title VII, ADEA, USERRA, AAP, etc.
  • Draft employment agreements, severance agreements, and legal correspondence
  • Provide support and guidance on revisions for the US / Canada Associate handbooks and state/provincial supplements
  • Assist Garmin before state and federal administrative agencies, including the EEOC, state and local human rights agencies, unemployment tribunals as well as in mediations and arbitrations
  • Support and assist in preparation of position statements and formal responses to human rights complaints
  • Support and assist in internal investigations
  • Assist in due diligence on labor and employment related aspects of mergers and acquisitions
  • Research and address complex issues related to restrictive covenants
  • Research and address complex employment-related legal issues through effective utilization of electronic tools (Westlaw, proprietary products, etc.)
  • Perform all the litigation specific functions described under "Litigation" below with respect to employment, benefits and labor litigation and claims

Litigation:
  • Support in providing legal counsel and advice related to threatened or actual employment law disputes and threats and issues
  • Assist with the management of outside counsel representing Garmin in adversarial proceedings, including litigation, arbitration, mediation and government investigations
  • Collaborate with and support outside litigation counsel by communicating objectives, providing strategic direction and providing ongoing information and support in order to meet expectations and achieve Garmin objectives
  • Assist in the review of work product of outside litigation counsel to ensure product quality and that expectations are met
  • Facilitate the internal discovery process (collection of materials, documents, etc.) utilizing Garmin's internal systems and tools
  • Facilitate and support complex discovery, including depositions of Garmin associates, litigation holds, production of documents and electronically stored information
  • Identify, classify, maintain, and protect files, documentation and sensitive information consistent with record handling and retention requirements
  • Assist in the management outside litigation counsel budgets, fees and expenses and review and approve invoices

Basic Qualifications
  • Juris Doctorate from an ABA accredited law school or a recognized European law school or Asian law school in the case of Senior EMEA Counsel or Senior Asian Counsel, respectively AND a Bachelor's Degree AND an excellent undergraduate and law school academic record AND a minimum of 4 years of experience performing the essential functions of this position as either an in-house attorney or private practice attorney
  • For U.S. based positions, admission to the applicable state bar in the location of employment

  • Demonstrate an aptitude to learn and effectively apply legal knowledge in the business context
