Full Job Description
POSITION OBJECTIVE

The ERISA Attorney will advise plan sponsors, fiduciaries, and administrators regarding the Employee Retirement Income Security Act (ERISA) compliance and governance of plan administration. This position will represent clients before the Department of Labor (DOL), Internal Revenue Service (IRS), and the Office of Inspector General Pension Benefit Guaranty Corporation (PBGC).
  • Advise clients on fiduciary responsibilities and daily plan administration issues.
  • Counsel clients on the design, drafting, implementation, and ongoing compliance of qualified retirement plans, employee stock ownership plans (ESOPs), and executive compensation arrangements.
  • Advise business and nonprofit clients regarding health plans, flexible spending accounts (FSAs), health savings accounts (HSAs), health reimbursement accounts (HRAs) cafeteria plans and health insurance portability and accountability act (HIPPA) compliance.
  • Advise businesses and nonprofit clients on complex compliance, regulatory, and transactional matters related to qualified retirement plans and health and welfare benefit programs.
  • Represent clients before regulatory agencies in audits, investigations, compliance and plan termination matters.
  • Draft and review plan documents, amendments, summary plan descriptions (SPDs), summaries of material modifications (SMMs), and other compliance related communications.
  • Collaborate with attorneys in corporate, tax, and labor and employment practice groups to deliver integrated client service.
  • Develop and implement project management plans to track progress.
  • Perform legal research to stay advised on the latest developments in employee benefit plan compliance.

WORK ENVIRONMENT/PHYSICAL DEMANDS

While performing the duties of the job, the employee must be able to:

Travel about 10% of the day to worksites beyond the corporate office, representing Tucker Arensberg, P.C. Will perform sedentary work exerting up to ten (10) pounds of force occasionally and/or negligible amount of force frequently or constantly to lift, carry, push, pull, or otherwise move object. Must see, hear, talk, and perform tasks requiring manual dexterity; kneeling, standing, walking, crouching, stooping, reaching, and other similar tasks requiring physical activity. Will operate a computer, fax, copier, and telephone. Work is generally performed in a temperature-controlled office environment.

REGULAR SCHEDULE

This is a salaried full-time position with a regular schedule of Monday through Friday work hours. An in-office schedule is highly encouraged until established. Following that period a hybrid, self-paced workday is acceptable with an annual expectation of 1,900 billable hours.
