Job Summary

Position Overview

We are seeking a highly motivated, hard-working, and experienced Senior Patent Counselto join our Intellectual Property team. This role will report to the VP, Chief IP Counsel and will play a critical role in building and protecting Insulet’s intellectual property portfolio through hands-on patent preparation, prosecution, and strategic portfolio development. The successful candidate will work closely with inventors, engineers, scientists, business leaders, and a lean IP team to identify patentable innovations, prepare high-quality patent applications, and develop prosecution strategies that support Insulet’s long-term business objectives.

The ideal candidate will have substantial experience drafting and prosecuting patent applications in-house or at a leading intellectual property law firm, strong technical aptitude, and a demonstrated ability to translate complex technologies into valuable patent assets.

Key Responsibilities

  • Prepare and prosecute U.S. and international patent applications covering a broad range of technologies, including medical devices, software, algorithms, user interfaces, digital health technologies, and machine learning.

  • Conduct invention disclosure reviews and invention harvesting sessions with engineers, scientists, and cross-functional development teams.

  • Draft high-quality patent applications, including specifications, claims, abstracts, and drawings or drawings instructions.

  • Develop and execute prosecution strategies that maximize patent scope while supporting Insulet’s business and product objectives.

  • Manage domestic and international patent portfolios, including coordination with foreign associates and oversight of international filing strategies.

  • Analyze Office Actions and prepare responses before the USPTO and foreign patent offices.

  • Collaborate closely with R&D and product development teams throughout the innovation lifecycle to identify and protect emerging technologies.

  • Conduct patentability analyses and assist in evaluating invention disclosures for strategic filing decisions.

  • Conduct freedom-to-operate, patentability, and infringement analyses.

  • Monitor competitor patent activity and industry patent trends to identify risks and opportunities.

  • Support portfolio optimization efforts, including continuation, divisional, and foreign filing decisions.

  • Provide training and guidance to inventors regarding invention disclosures, patent strategy, and best practices for protecting innovation.

  • Maintain strong awareness of developments in patent law and patent office practice that may impactInsulet’s patent portfolio.

  • Assist with and negotiate IP-related aspects of transactions, including licensing, M&A, and collaborations.

  • Educate internal stakeholders on IP best practices and emerging trends.

  • Perform all responsibilities with a high degree of strategic thinking, business alignment, and commitment to building long-term competitive advantage.

Qualifications

  • J.D. from an accredited U.S. law school and admission to practice before the USPTO and at least one U.S. state.

  • Minimum of 8 years of experience in patent law, preferably with a top-tier law firm and/or an innovative technology company. Experience as a patent examiner is a plus.

  • Demonstrated excellence in patent drafting, claim strategy, and patent prosecution before the USPTO.

  • Significant experience developing and managing strategic patent portfolios.

  • Bachelors degree or higher in Computer Science, Computer Engineering, Electrical Engineering, Physics, Mechanical Engineering, Biomedical Engineering, or a closely related technical discipline.

  • Experience working directly with inventors and engineering teams in a fast-paced product development environment.

  • Experience with medical devices, wearable technologies, diabetes technologies, software-enabled devices, digital health platforms, or regulated healthcare products is strongly preferred.

  • Strong understanding of software-related inventions, AI/ML technologies, connected devices, sensors, user interfaces, and digital health systems is desirable.

  • Excellent written communication skills with demonstrated ability to draft complex patent applications and claims.

  • Strong analytical, project management, and interpersonal skills.

  • Ability to independently manage substantial prosecution responsibilities while effectively collaborating within a fast-paced, leanteam environment.

Additional Information:

Compensation & Benefits: For U.S.-based positions only, the annual base salary range for this role is $230,000.00 - $344,975.00 This position may also be eligible for incentive compensation.
