Job Description:
Reporting to the Senior Director of Gift Compliance & Disbursements, the Director of Donor Intent Compliance will lead fund modification efforts for the University. This position will also ensure funds are established in accordance with donor intent and with the ability to be utilized. The Director of Donor Intent Compliance will be a public face to UF Advancement and to Main Campus on various compliance initiatives- through the production of educational materials and via policy management.
Fund Modification - Lead all fund modification efforts for UF Advancement.
- Establish a centralized fund modification tracking system to monitor the progress of ongoing modifications.
- Serve as the subject matter expert for Development on fund modification policy and process.
- Lead training sessions on fund modification for Advancement and non-Advancement stakeholders.
- Report on fund modification efforts on regular basis.
- Conduct due diligence on donor funds to determine if they qualify for modification.
- Assist the Senior Director with preparation of fund modifications for review by the UFF Audit Committee.
- Research funds and donor intent on behalf of stakeholders.
- Consult with University's Office of General Counsel when needed to ensure that approach is consistent with the University's direction.
- Coordinate with and support the Low Utilization Project.
- Work with University's Office of General Counsel on funds that will go to court.
- Lead the Foundation's review of non-compliant fund purposes per the requisite state and federal statutes.
Gift Establishment - Manage the process with the goal of providing development staff with efficient, fast, pleasant experience with creating gift agreements.
- Actively participate in the gift agreement process, including reviewing all requests for gift agreements, clarifying requests as needed, assigning drafts to individuals on the gift agreement team, assisting team members with questions, and overseeing entire process for responsiveness, accuracy, and efficiency.
- Work closely with UFF Program Management team to continue to enhance the gift agreement process.
- Provide consistency in communications and fund purposes with standard language for emails, DocuSign, gift agreements, and fund purposes.
- Review gift agreements to identify additional donor requirements that are not captured in the fund purpose.
- Approve the creation of new funds (endowed and non-endowed) to ensure compliance with donor intent.
- Work with Program Management Team to establish a process to identify and document new standard funds.
Policy Review - Serve as a key partner to the Senior Director of Risk Management in reviewing and auditing current organizational policies.
- Evaluate emerging regulatory requirements and translate them into actionable organizational policies and controls.
- In partnership with the Senior Director of Risk Management, monitor and review the organization's policy governance framework, ensuring policies remain current, effective, and aligned with legal, regulatory, and industry expectations.
Training & Education - Produce educational materials for fund modifications- including UPMIFA information.
- Lead training sessions on topics such as fund modifications; gift restrictions; and policy maintenance.
- Assist Senior Director and the Director of Gift Compliance & Disbursements with additional training materials pertaining to the Optimizing Donor Funds Initiative.
- Partner with development officers and donors' advisors in establishing gift purposes that comply with the law, University policies and operations, and Foundation policies and operations, and that reflect best practices.
- Partner with senior development and Talent Management to develop and implement best practices training for gift restrictions and documentation.
Audit- Conduct audits of Foundation funds to ensure expenditures are compliant with donor intent and UF policies.
- Participate in special auditing projects as requested from Colleges and Units across campus.
- Work with the Director of Gift Compliance & Disbursements on gift agreement audits and scholarship audits.
Expected Salary:

Required Qualifications:
Master's degree in appropriate area of specialization and three years of appropriate experience in Risk Management or a related field; or a bachelor's degree in appropriate areas of specialization and five years of experience in Risk Management or a related field.
A valid Florida driver's license is required.
Preferred:
The ideal candidate will possess:
- Experience interpreting and applying laws, regulations, policies, and compliance requirements in a professional setting preferred.
- Juris Doctor (J.D.) or other legal training is preferred but not required.
- Proven success working with stakeholders; excellent strategic planning and project management skills; experience in a data-driven environment; organizational skills; and the ability to lead, influence and motivate others.
- Previous experience working in compliance or other related fields.
- Must have the ability to work collegially with a wide variety of stakeholders. Must be able to manage multiple projects at one time and keep colleagues updated on deliverable status.
- Previous experience leading presentations to a variety of stakeholders.
- Previous experience working for nonprofit organizations.
- Ability to communicate effectively with a variety of contacts, including executive leadership, board members, colleagues, outside counsel and business associates.
- Ability to produce educational materials such as guidelines, procedures, and desk manuals.
- Exceptional written and verbal communication skills, strong interpersonal abilities, and the capacity to engage effectively and collaboratively with a wide range of individuals.

- Proficient in the following areas: Windows operating systems, Microsoft Word, Excel, and Access, as well as internet browsers and email platforms. Experience in a data-driven environment, familiarity with donor databases, contact management systems, and tracking systems is also highly preferred.
