Full Job Description
The Executive Agency Counsel will serve as the Director of Equal Employment Opportunity (EEO) Investigations and report directly to the Executive Director of the Office of Equal Employment Opportunity. The Director will provide executive leadership, legal guidance, and operational oversight for the Department's EEO Investigations Team and will ensure that allegations of employment discrimination, harassment, retaliation, and related workplace misconduct are investigated promptly, thoroughly, impartially, and in accordance with applicable federal, state, and local laws, Department policy, and accepted investigative standards. The Director will oversee the EEO Investigations Team Leads and their respective teams and will promote consistency, accountability, and quality throughout the investigative process. The duties and responsibilities will include, but are not limited to: - Providing executive supervision, guidance, mentoring, and performance management to the EEO Investigations Team Leads and the EEO Investigations Team. - Directing and overseeing all EEO investigations from intake through final disposition and ensuring timely completion of investigative activities. - Reviewing investigative reports, findings, and recommendations to ensure legal sufficiency, consistency, accuracy, and quality before submission to executive leadership. - Advising the Executive Director and Department executives on significant Equal Employment Opportunity matters, complex employment discrimination issues, and investigative findings. - Implementing investigative policies, procedures, quality assurance standards, internal controls, and best practices to ensure consistency across the investigations program. - Monitoring investigative caseloads, workflow, staffing, productivity, and performance metrics, while allocating resources to support timely case resolution. - Conducting quality assurance reviews and audits of investigative files to ensure compliance with Department policy. - Identifying complaint trends, recurring issues, and organizational risks, and recommending policy, operational, and procedural improvements. - Preparing executive reports, statistical analyses, management briefings, and other materials regarding investigative operations and program performance. - Coordinating with Department executives and stakeholders concerning significant or sensitive investigations. - Ensuring compliance with applicable federal, state, and local Equal Employment Opportunity laws, rules, regulations, and Department policies. Prior experience should include significant litigation experience in constitutional and criminal issues. The candidate should also have familiarity with Department policies and operations, through knowledge of legal strategies and methodologies and outstanding written and verbal skills. EXECUTIVE AGENCY COUNSEL - 95005 Qualifications Admission to the New York State Bar; and four years of recent full-time responsible, relevant, satisfactory legal experience subsequent to admission to any bar, eighteen months of which must have been in the supervision of other attorneys, in an administrative, managerial or executive capacity, or performing highly complex and significant legal work. Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
