What’s the role?

We are looking for a Director, Assistant General Counsel, Marketing. In this role you will use your experience in marketing and advertising law to help manage key business and marketing functions. Do you have a background advising internal clients on global ad marketing campaigns, copy reviews, martech issues (including performance marketing, SEO, SEM and CRM), claims substantiation, customer reviews, advertising compliance (including FTC), branding, intermediary liability, and related contracts with agencies, media, and AdTech providers? If so, this could be an excellent match.

This is a full-time position reporting to the Director, Assistant General Counsel, Marketing. This role will also be responsible for hiring and onboarding a direct report (also a marketing counsel).

What does the day-to-day look like?

  • Advise and identify risks to marketing and creative teams as they promote and design exciting strategies, campaigns, and experiments.
  • Balance commercial, marketing, compliance and privacy concerns, including advertising campaigns (US and internationally) with social media reviews, and consumer and business insights.
  • Evaluate risks and opportunities related to a company’s media assets and priorities, including global and domestic marketing campaigns, influencer and affiliate programs, Above the Line (TV, radio and Out of Home), talent and SAG-AFTRA concerns, UGC, content clearance and production, technology partnerships, merchandise vetting, music licensing, and content distribution.
  • Answer new questions, solving uncharted problems.
  • Work collaboratively with teams to meet the needs of our fast-paced environment, and raise matters when needed to internal partners/groups.
  • Navigate marketplace issues, including: privacy (US and international regs), intermediary liability, ad technologies, cookies and trackers, EU and FTC regulations, COPPA, accessibility, SaaS and IaaS, and more.
  • Collaborate with the commercial team on a wide range of US & international marketing agreements (especially experience with publicity releases, talent agreements, intellectual property rights, media buys, etc).
  • Of course, this is just a sample of the kinds of work this role will require! You should assume that your role will encompass other tasks, too, and that your job duties and responsibilities may change from time to time at Etsy's discretion, or otherwise applicable with local law.

Qualities that will help you thrive in this role are:

  • 10+ years experience, at both a law firm and in-house, dealing with issues related to marketing and advertising for tech and/or e-commerce companies.
  • JD and are admitted to a state bar (preferably NY or CA) and are qualified to work in-house in New York.
  • History of being the trusted legal contact for creating and publishing advertising campaigns reaching audiences in various media, TV commercials and social media posts.
  • Effective communicator, verbally and in writing. History of speaking with technical minds and business leaders without legal jargon. Passionate about clearly articulating risk and strategies to mitigate risk to clients and executives.
  • Embrace goal setting and accountability.
  • Excellent business, negotiation and presentation skills. You can read a spreadsheet, build a deck, analyze, and communicate information to others.
  • Skilled at identifying, understanding, and managing international legal and regulatory risks related to our business.
  • Bilingual/multilingual is a plus (English/Spanish/Portuguese/French/German).
  • The most important quality for success on the Etsy legal team is good judgment. Knowing when to say “no”, “yes” or “maybe". You are mindful that the company is your client, and you advocate for the protection of your client.

Compensation & Benefits

In addition to salary, you'll be eligible for an equity package, an annual performance bonus, and our that support you and your family. Base salary is determined by your location, skills, and experience.


Etsy uses two geographic pay zones to reflect the labor markets where we compete for talent: one called Geo-1, covering the New York City metropolitan area, San Francisco Bay Area, and Seattle metropolitan area, and one called Geo-2, covering all other U.S. locations. Salary ranges for this role vary by zone and are listed below.


Location

We prioritize candidates based within commutable distance of Etsy’s Brooklyn Office. Depending on proximity, we ask team members to come in once or twice per week. Remote candidates outside commutable distance may be considered on a case-by-case basis, with the expectation of occasional travel to the office. Salary Range:

• Geo-1: 264,000.00 - 358,000.00 USD Annual • Geo-2: 238,000.00 - 322,000.00 USD Annual
