Full Job Description
The Associate General Counsel - Regulatory Affairs and Compliance serves as a key member of the legal team and is responsible for supporting the legal, regulatory, and compliance functions of one of the nation's largest apartment management companies. Reporting directly to the Chief Legal Officer, this position provides strategic legal guidance related to real estate brokerage operations, multi-state regulatory compliance, audit responses, risk management, contracts, and litigation oversight.

This role will partner closely with operations, client services, finance, risk management, and external legal counsel to ensure compliance with evolving federal, state, and local laws affecting property management and real estate brokerage activities. The successful candidate will combine strong legal expertise with practical business judgment and a proactive approach to identifying and mitigating legal and regulatory risk.

Responsibilities include:

Regulatory & Compliance Supervision (Including Brokerage)

Oversee compliance with applicable laws, licensing requirements, agency regulations, and professional standards-including real estate brokerage requirements-across all jurisdictions where the company operates.

  • Develop, implement, and maintain policies, procedures, and compliance programs, including those governing brokerage operations.
  • Partner with regional and operational leadership teams to ensure adherence to state-specific regulatory and brokerage requirements.
  • Provide guidance regarding broker supervision requirements, advertising compliance, disclosures, licensing obligations, trust account matters, and real estate transaction compliance.
  • Monitor and assess regulatory developments impacting the company's operations, including brokerage and property management activities.

Legislative & Regulatory Monitoring

  • Partner with local counsel, industry associations, and compliance resources to identify emerging legal and regulatory developments.
  • Analyze new legislation, administrative rules, and regulatory guidance affecting property management, landlord-tenant operations, fair housing compliance, utility billing, rent advertising and fee disclosures (including all-in pricing), revenue management laws and various state security deposit, late fee and tenant protection regulatory activities.
  • Develop implementation strategies and operational guidance to ensure timely compliance with regulatory changes.
  • Conduct legal research and provide practical recommendations regarding evolving legal requirements.

Audit & Regulatory Response Management

  • Lead legal responses to real estate commission audits, regulatory inquiries, investigations, and examinations.
  • Coordinate document production, information gathering, and communications with governmental agencies and regulators.
  • Work closely with operational leaders to address audit findings and implement corrective action plans where necessary.
  • Maintain records and reporting related to regulatory audits and compliance activities.

Contract Review & Commercial Support

  • Draft, review, negotiate, and revise a variety of contracts, including:
    • Vendor agreements
    • Service contracts
    • Confidentiality agreements
    • Brokerage-related agreements
    • Owner and client-facing documents
    • Operational and compliance-related agreements
  • Provide practical legal guidance to internal stakeholders regarding contractual obligations, risk allocation, indemnification provisions, and liability exposure.
  • Assist in the development of contract templates, playbooks, and approval processes.

Litigation & Dispute Management

  • Support the Chief Legal Officer in managing low-to-moderate complexity litigation matters.
  • Coordinate with outside counsel regarding claims, disputes, administrative proceedings, and regulatory enforcement actions.
  • Assist with litigation strategy, budgeting, document preservation, discovery matters, and settlement negotiations.
  • Monitor litigation trends and provide recommendations for reducing future legal exposure.

Legal Advisory & Risk Management

  • Serve as a trusted legal advisor to internal business partners.
  • Provide guidance regarding:
    • Fair housing compliance
    • Landlord-tenant laws
    • Utility billing regulations
    • Consumer protection requirements
    • Regulatory risk
    • Operational policies and procedures
  • Identify and proactively address legal risks affecting business operations.
  • Assist with development and delivery of legal and compliance training for field and corporate personnel.

Requirements:

  • 5-8+ years of legal/litigation experience, preferably both law firm and in-house
  • JD from accredited law school
  • Experience working in a multistate organization and complying with federal, state, and local employment laws Admitted to practice in relevant jurisdiction
  • Expertise in general litigation, preferably with corporate, landlord/tenant, general liability, employment, and personal injury experience.
  • Excellent written and verbal communication skills - the ability to summarize complex issues for non-legal colleagues and to present sophisticated issues in a clear and persuasive manner
  • Experience with litigation and administrative proceedings
  • Experience with arbitration and mediation
  • Experience dealing with ownership groups of properties, tenant matters and advising property management staff.
  • A demonstrated verifiable reputation for integrity and no history of disciplinary offenses as an attorney or in any other capacity

Compensation: Full Time - DOE $170,000.00 to $200,000.00 annually
