Full Job Description
The Law Office of Kimberly L. Kelly, LLC is hiring a full-time associate attorney to handle probate matters and mental health commitments at our successful legal practice based in a small and friendly office environment just north of Boston. The attorney will represent clients in the Probate and Family Court in guardianship, conservatorship, and estate matters pursuant to M.G.L. c. 190B, Article V. The attorney will also represent clients in the District Courts in civil commitment hearings and substituted judgment hearings pursuant to M.G.L. c. 128 §§ 7, 8, & 8B.

Three plus years experience is required. Our ideal candidate will be able to take initiative and complete tasks with minimal direction.

Our associate will be responsible for legal work including, but not limited to, the following:
• Understanding and applying M.G.L. c. 128 §§ 7, 8, & 8B and the substituted judgment line of cases;
• Understanding and applying M.G.L. c. 190B;
• Meeting with Doctors to prepare cases and discuss relevant evidence;
• Meeting with Social Workers to prepare cases and gather relevant evidence and documents;
• Meeting with professional and family witnesses and preparing them to testify at civil commitment hearings and/or probate court hearings;
• Communicating with opposing counsel;
• Filing various Petitions and Motions with the District Court and Probate and Family Court;
• Attending court appearances in the Probate and Family Court; and
• Attending court appearances for Civil Commitment Hearings and other related matters in the District Court.

- Are ready to work approximately 40 hours per week in the Stoneham office;

- Are passionate about assisting clients and families with all facets of elder care and disability law;

- Have a demonstrated commitment to elders and/or special needs individuals;

- Enjoy getting to know families one at a time and helping each work through their particular web of issues and goals;

- Are happy to manage all probate matters;

- Are able to work with people in crisis and/or with diminishing capacity;

- Have strong verbal communications skills;

- Have impeccable writing skills;

- Have down-to-earth, approachable personality;

- Are exceptionally detail oriented;

- Have ability and desire to work independently;

- Are familiar with Macs, or, happy to learn them;

- J.D. with a Massachusetts license.
