Responsibilities

Full Job Description
This position provides government-wide advice, develops policy, and provides overall direction and leadership in matters related to access and privacy and the administration of the Freedom of Information and Protection of Privacy Act (FOIPP Act) and its regulations. The position provides day-to-day management to the Access and Privacy Services Office (APSO).

Duties will include but are not limited to:
  • Provide advice and guidance on the appropriate collection, use and disclosure of personal information pursuant to the FOIPP Act;
  • Provide advice and guidance on the active dissemination and/or proactive disclosure and/or disclosure related to formal requests pursuant to the FOIPP Act of government records and information;
  • Anticipate contentious issues related to access and privacy and recommend effective solutions;
  • Maintain current, in-depth knowledge and understanding of access and privacy matters including amendments to legislation, orders/rulings, and decisions of the Office of the Information and Privacy Commissioner of PEI, and the Commissioner's of other jurisdictions, and practices and policies across Canada and apply this knowledge when providing advice;
  • Lead and/or liaise with intergovernmental working groups or corporate projects that result in improved access to information and privacy protection;
  • Develop government-wide policies and/or practices to respond to access and privacy issues;
  • Interpret and analyze statistics, develop, write and distribute useful reports (monthly, quarterly and annual) and matters flowing through the APSO office;
  • Develop, implement and evaluate APSO operational plan on an annual basis;
  • Develop and deliver relevant and timely employee orientation and/or training and materials related to the interpretation and application of the Act (part of new Deputy Minister/CEO training as Heads of Public Bodies);
  • Maintain up-to-date PQs for APSO staff and lead in the hiring and orientation of new staff;
  • Allocate responsibilities to APSO staff, coordinate, schedule, assign and monitor work and evaluate performance of APSO staff to ensure access to information requests are processed pursuant to the FOIPP Act;
  • Manage and motivate APSO employees by recognizing their contributions and expertise; create a climate that fosters continuous learning, teamwork, and focus on service improvement by encouraging employees involvement in decision making;
  • Represent the province as an active participant on the FPT Access and Privacy Subcommittee.

Minimum Qualifications:
  • A university degree in any related discipline supplemented by considerable experience interpreting and advising on legislation and regulations, with a strong preference for experience in interpreting/applying with the Freedom of Information and Protection of Privacy Act;
  • Demonstrated equivalencies will be considered;
  • An access and privacy certificate from an approved institution, or willingness to complete certification within a three-year period;
  • Advanced organizational and time management skills; demonstrated adaptability to unforeseen changes in schedules and interruptions; ability to establish priorities, meet deadlines within timelines and manage a high workload;
  • Effective communication skills with experience developing and presenting information, advice and recommendations to senior leaders;
  • Effective negotiation and conflict resolution skills;
  • Strong interpersonal skills with the ability to develop, foster and maintain respectful relationships with both internal and external parties;
  • Good judgment with the ability to work with sensitive information in a confidential manner;
  • Experience in program planning and evaluation;
  • Experience supervising, coaching, setting goals and evaluating performance for staff;
  • Strong oral and written communication skills for presentations and training;
  • Considerable knowledge of record management, financial administration and human resource policies.

Other Qualifications:
  • Lean Six Sigma, process improvement and/or project management training would be an asset;
  • Experience in developing and delivering education and training would be an asset.
