Full Job Description
The Prosecution Division investigates and prosecutes all summonses issued by TLC, amounting to over 100,000 summonses each year. Under the supervision of the Associate Commissioner and Managing Attorney for the Prosecution Division, the Senior Supervising Attorney oversees prosecuting attorneys and supervising attorneys assigned to the Adjudications and ARTS units, and manages the prosecution of TLC summonses at OATH Hearings Division. Responsibilities include, but are not limited to, managing the weekly and daily calendar of TLC summonses; assigning and monitoring cases handled by prosecuting attorneys; overseeing the preparation of evidence and witnesses for administrative hearings; collaborating with OATH to ensure efficient case disposal; coordinating with TLC enforcement staff to ensure officer presence at required court appearances; providing instruction and feedback to prosecuting attorneys as needed; participating in regulatory review and recommendations regarding TLC rules affecting drivers; and reviewing and editing appeals, as well as overseeing the prosecution of seizure matters and forfeiture proceedings in civil court. Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment. In addition to meeting the minimum Qualification Requirements: To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.
