Overview

Position:  Senior Servicing Attorney

 

Location: Austin, TX (4 days on-site) - open to Remote if located outside 30 miles of Austin, TX

**Must be able to work CST hours***

 

Compensation:  Starting at 140K+ d.o.e.

 

JOB SUMMARY:

The Legal Department is responsible for managing litigation, regulatory complaints, compliance and other legal matters that arise in New American Funding’s servicing of mortgage loans. The Senior Attorney reports to the General Counsel as a member of the Legal Department and is primarily responsible for supporting the servicing division. Primary responsibilities are managing servicing litigation, regulatory complaints, title claims and general legal and compliance issues as part of NAF’s legal risk management efforts.

Responsibilities

ESSENTIAL FUNCTIONS:

 

The Senior Attorney is responsible for the management of servicing litigation, regulatory complaints and advising on legal and compliance issues relating to the servicing division. Duties include:

 

• Oversee and manage servicing, title and escalated contested foreclosure litigation as well as oversee title claims involving NAF’s loans;• Legal support for the servicing division, including the following responsibilities: (i) research and prepare responses to qualified written requests, (ii) requests for information and debt disputes, (iii) review loan files and legal documentation, and (iv) advise operational departments on legal issues such as modification agreements and successors in interest; and (v) assist the servicing division with customer escalations and disputes;• Oversee and manage regulatory complaints, including file review and legal analysis, as well as communications with regulatory agencies and attorneys general;• Review and approve customer-facing correspondence, scripts and email communications;• Assist vendor management in reviewing and monitoring third party vendors of the servicing division as well as perform periodic reviews of default law firm compliance with federal, state and investor/insurer requirements;• Review and approve NAF’s servicing policies, procedures, disclosures and other documentation for compliance with federal, state and investor/insurer requirements;• Assist with servicing-related legal and compliance issues for NAF’s compliance and operational departments, including fraud investigations and inquiries;• Assist in preparing litigation and complaint reporting to clients, investors and regulatory agencies, as required; and• Legal and compliance matters, as assigned.

Qualifications

QUALIFICATIONS - Education and Experience:

 

• Juris Doctor degree required and licensed attorney in good standing in the state for which the attorney practices law• 5-7 years of legal experience involving mortgage servicing, including debt collection, foreclosure and bankruptcy laws, in-house experience strongly preferred• Extensive knowledge of federal, state and investor/insurer requirements, including CFPB requirements and Fannie Mae, Freddie Mac, FHA and VA guidelines• High degree of professional ethics and integrity• Organized and detail-oriented• Excellent interpersonal and communication skills• Team-oriented
