Responsibilities

  • Advise on various employment issues nationwide, including hiring, performance management, and internal investigations.
  • Identify compliance risks and develop practical strategies to mitigate them.
  • Conduct compliance audits and provide strategic legal counsel related to employment practices.
  • Investigate agency charges, government audits, and demand letters efficiently and accurately.
  • Draft and revise company policies in line with evolving laws and regulations.
  • Monitor relevant legislation and effectively communicate updates and recommendations to key stakeholders.
  • Collaborate with HR, Training, and Compliance teams to implement training initiatives.
  • Involves occasional travel as needed for the role.

Senior Counsel, Employment & Compliance

Full time • San Francisco • Hybrid

In this role, you will support employment counseling and compliance efforts for Flynn Group's restaurant and fitness brands. This is the perfect opportunity for someone looking to accelerate their professional development while playing a meaningful part in the growth story of a family of companies featuring some of the most recognizable brands in the world (Applebee's, Taco Bell, Panera, Arby's, Wendy's, Pizza Hut, and Planet Fitness). The role will report to the Associate General Counsel, Compliance.

The position may be based in any of our Support Centers located in San Francisco, CA; Cleveland, OH; Overland Park, KS, or Dallas, TX.

Responsibilities
  • Provide advice and counsel across a broad spectrum of employment issues nationwide, including wage and hour, payroll, benefits, hiring, performance management, internal investigations, leaves of absence, discipline, terminations, and employee classification.
  • Proactively identify areas of compliance risk and pragmatic solutions to address them.
  • Design and provide strategic counsel on compliance audits, including wage and hour and onboarding forms.
  • Investigate and respond to agency charges, government audits, and demand letters.
  • Support drafting and updating/revising company policies, including in response to changes in laws and regulations.
  • Monitor federal, state, and local legislation, regulations, and case law on employment-related matters pertinent to the company; communicate updates and recommendations as needed.
  • Coordinate with HR, Training, and Compliance to create and implement training initiatives.
  • Occasional travel may be involved.


Requirements
  • 7+ years of employment law (litigation) experience, including California wage and hour matters; additional experience litigating tort and/or commercial matters a plus.
  • Juris Doctor from an accredited law school; must have Bar admission in good standing, California Bar admission or deep knowledge of California law strongly preferred.
  • Excellent knowledge of federal and state employment laws and regulations across the country (including Title VII, ADA, FMLA, FLSA, FEHA, PAGA, etc.) and experience with federal and state agencies (DOL, EEOC, DLSE, DFEH, etc.).
  • Experience providing pragmatic and actionable advice to clients with nationwide operations on compliance and employment laws preferred; experience doing so as in-house counsel a plus.
  • Entrepreneurial mindset that enables you to work independently with little guidance, but also to use good judgment and escalate issues when needed.
  • Demonstrated ability to guide multiple objectives and initiatives simultaneously.
  • Dedication to exceptional client service.

California-Based Candidates: The good faith estimated range of pay for the above position when based in California is $180,000 - $200,000 depending on factors including but not limited to experience and skill. There is a target discretionary incentive bonus of 20%.
