We are currently looking for a highly skilled, caring, and safety focused individual for our team. Reporting to the EVP of Corporate Services, the Litigation Counsel is Buttcon's in-house specialist for construction disputes and litigation. This role is responsible for leading the strategy, management, and resolution of all formal disputes including litigation, arbitration, adjudication, and complex claims. Working closely with Legal, Risk Management, and Operations, the Litigation Counsel ensures the Buttcon Central Division is well-positioned in all disputes, minimizes legal exposure, and drives efficient, commercially sound outcomes. This position requires excellent organizational skills, strong negotiation abilities, and a deep understanding of construction law with 5+ years of litigation experience.
Responsibilities
- Lead all active litigation matters, including construction liens, breach of contract claims, delay claims, and deficiency disputes.
- Manage all aspects of litigation and provide pre-litigation counseling to internal teams.
- Develop and execute litigation strategy in partnership with external counsel.
- Oversee pleadings, affidavits, discoveries, expert reports, and trial/arbitration preparation.
- Represent the company in mediations, arbitrations, and settlement negotiations.
- Work with cross-functional partners across Buttcon, including Legal, Risk, Operations, and Construction teams, to provide counseling on existing and potential litigation matters and advise on litigation risk.
- Provide clear, practical guidance on exposure, likelihood of success, and settlement positioning.
- Support decision-making on whether to litigate, settle, or pursue alternative dispute resolution.
- Provide legal input on high-risk claims before escalation.
- Identify root causes of disputes and recommend operational or contractual improvements.
- Support training for project teams on dispute avoidance and documentation best practices.
- Act as a liaison between project leaders and external legal counsel for complex claims and litigation.
- Management of various litigation files and developing and implementing strategies and solutions to mitigate risks.
- Stay updated on industry trends and legal developments, providing insights to management to inform decision-making.
- Perform additional duties as assigned to support the legal and risk management functions.
Qualification & Skills
- Law degree (LL.B. or J.D.)
- Current license in good standing with the Law Society of Ontario
- 5+ years of litigation experience, with a strong focus on construction law.
- Deep expertise with construction liens and trust claims, delay and impact claims, and arbitration and mediation.
- Experience managing external counsel and complex, multi-party disputes.
- Strong commercial acumen and ability to balance legal risk with business objectives.
- You are self-motivated, efficient and a "doer" and you have the ability to juggle competing projects and interests.
- Strong communication and interpersonal skills to collaborate effectively with internal and external teams.
Working Condition and Environment
- Primary work location in the Head Office
