Full Job Description
Responsibilities:

Mintz is looking for a Special Counsel with substantial commercial contracting experience in matters related to managed care or the pharmaceutical supply chain to join the Health Law Practice in New York or Washington, DC. This individual will support a team that advises national and regional health plans, particularly in their contracting relationships with pharmacy benefit managers (PBMs) and other pharmaceutical supply chain vendors. The role involves supervising associates on a wide range of commercial agreements and transactions that are central to the pharmacy benefit operations of health plans, payors, and other service providers and entities within the health care industry.

Responsibilities will include leading and managing all aspects of matters related to commercial contracting in the managed care and pharmacy benefit industries, with partner oversight. The role will require the Special Counsel to regularly draft, negotiate, and advise on contract administration of PBM contracts and PBM-related services agreements, including but not limited to rebate contracts, pharmacy network contracts, and other vendor arrangements. The Special Counsel will be responsible for leading the contracting lifecycle for PBM procurements for health plans, serving as a primary client contact, which may require travel from time to time to client sites for in-person meetings and contract negotiations.

The role also includes directly counseling clients in all aspects of health plan operations, including complex regulatory frameworks, transactional considerations, and other contract administration issues, including disputes that arise under clients' contracts with PBMs, health plans, and other third-parties.

Experience drafting and negotiating complex commercial contracts, managing multiple contract workflows, and coordinating with clients, co-counsel, and opposing counsel is required. The Special Counsel will be expected to independently lead day-to-day client engagements, contract negotiations, and work streams while communicating closely with partners and Mintz team members. Attention to detail, strong organizational and communication skills, and the ability to anticipate and respond to client needs quickly and effectively are critical. Attorneys working in-house in the managed care industry or senior associates and counsel with managed care or pharmaceutical supply chain transactional experience are encouraged to apply.

Collaboration with team members is an important component of any role at Mintz. Therefore, the firm requires working from the office approximately 60% of the time in accordance with the firm's published guidelines.

Qualifications:

Candidates with experience in complex commercial and/or transactional matters in the PBM or managed health industry are preferred, particularly those familiar with federal and state regulations of health plans, pharmacy benefit managers, and other pharmaceutical supply chain providers and related entities.
  • Graduated with a JD or LLM from an ABA-accredited law school
  • Admitted to or eligible for admission in New York or Washington, DC
  • Substantial transactional experience in the managed care or pharmaceutical supply chain industries
  • Excellent written and verbal communication skills
  • Professionalism in working and engaging with demanding clients
  • Ability to balance and prioritize multiple competing priorities and responsibilities
  • Ability to stay organized and exercise extreme attention to detail
  • Ability to collaborate and work effectively in team settings

The salary range for this position is $200,000 to $345,000. This position is bonus eligible.
