Export Compliance Manager to lead and enforce our global trade compliance program, with a specialized focus on U.S. Export Administration Regulations (EAR) and South Korean National Core Technology (NCT) regulations. The ideal candidate brings a strong legal and compliance background, overseeing the classification, licensing, and safeguarding of our critical technologies. This role is instrumental in ensuring that we do not illegally share, export, or lose control of protected technologies to foreign entities, including our own global subsidiaries or international partners.
Responsibilities- Export Control & Regulatory Filings
- EAR & U.S. Compliance: Manage day-to-day U.S. export compliance operations, ensuring strict adherence to the Export Administration Regulations (EAR).
- Licensing & Classification: Review and approve export documentation, manage product classifications (ECCNs), and oversee export licensing activities and Technology Control Plans (TCPs).
- NCT MOTIE Approvals: Manage the government paperwork required before any NCT can be exported, licensed abroad, or shared with a foreign entity.
- Funding-Specific Declarations: Secure formal approval from South Korea's Ministry of Trade, Industry and Energy (MOTIE) if the technology was developed using Korean government funding. File a formal declaration if the technology was privately funded.
Technology Classification & Internal Security
- Technology Audits: Regularly audit the company's intellectual property, R&D, and manufacturing processes. Determine if any of our technology falls under the official NCT list maintained by MOTIE.
- Implementing Protected Zones: Enforce South Korean legal mandates by setting up physical and digital "protected zones".
- Personnel & Access Control: Audit personnel who have access to the tech. Maintain specialized confidentiality agreements to ensure internal security.
Strategic Advisory & Safeguarding Deals
- Cross-Border Transactions: Act as a critical advisor if the company is engaging in an M&A, setting up a joint venture, or building a manufacturing plant overseas.
- Risk Mitigation: Ensure that technology transfers during these deals do not violate South Korea's Act on Prevention of Divulgence and Protection of Industrial Technology (ITA). Prevent violations that could result in massive fines, criminal liability, or the Korean government outright canceling the business deal.
Qualifications- Education & Experience: Bachelor's degree in law, international business, compliance, or a related field, with 5+ years of direct experience in export compliance and legal frameworks.
- EAR Expertise: In-depth, demonstrable knowledge of the Export Administration Regulations (EAR), including ECCN classification, deemed exports, and licensing procedures.
- Technical Acumen: Ability to comfortably read complex technical specifications to accurately classify the company's technology, even without formal engineering training.
- Analytical Skills: Strong ability to conduct compliance risk assessments, audits, and red-flag reviews.
Preferred Qualifications- NCT Regulatory Expertise: Deep, demonstrable knowledge of South Korea's ITA and experience dealing directly with MOTIE.
- Bilingual Fluency: Fluency in both Korean and English. Ability to read highly technical government updates in Korean and clearly explain those compliance boundaries to English-speaking teams.
