MWHis currently seeking qualified candidates for the position of
Contracts Manager to support project work near Boring, OR.
The Contracts Manager will ensure compliance with government regulations, statutes, and conformance with MWH's policies and practices. This role will be dedicated to a large project near Boring, OR but may in the future support multiple projects of various sizes and complexity in other locations. It is expected that the successful candidate will have extensive knowledge of key components found in both standard and non-standard construction contracts and subcontracts (e.g., change orders, claims, indemnity, insurance, waivers of consequential damages, liability caps, force majeure, warranty, payment provisions, etc.), as well as experience in reviewing other related contract documents, such as non-disclosure agreements (NDAs), subcontracts, purchase orders, teaming agreements, joint venture agreements, rental agreements, management authority matrices, etc. This position also assists in change order development, negotiation, and management and execution of contracts and subcontracts in conjunction with Legal, Sales, and Operations.
The Contracts Manager will also support in ensuring compliance with MWH's policies and practices regarding cost controls. It is expected that the successful candidate will have knowledge of bids, estimates, and general accounting practices.
The ideal candidate should know "construction specific" contract and cost principles and understand how those principles should be properly allocated to eliminate or mitigate risk, and how to properly communicate risk and risk mitigation through financial reporting
Essential Functions
- This position will support the Project Package Managers with subcontract management, preparation of subcontract change orders, negotiation of contract terms and conditions to reduce risk exposure, and management of the cost controls associated with those changes, In accordance with MWH's policies and practices.
- This position will assist the Project Commercial Manager in development of Prime Contract Change Order Requests, substantiation of change order entitlement, and negotiations, in accordance with MWH's policies and practices.
- This position will assist the Project Commercial Manager and Project Cost Controller in managing the financial reporting of the Project to be aligned with Prime Contract and subcontract change orders, risks and claims.
- This position will support the Project Package Managers with questions pertaining to insurance and bond requirements, subcontracts, purchase orders, vendor agreements, prime contract terms and conditions, funding sources, etc.
- This position will coordinate with the Legal and Risk Team and advise the Project Commercial Manager on their package's contractual risk and provide recommendations to mitigate those risks.
- This position will participate in risk reviews and change management team reviews.
- This position will provide pre-claim and claim support and resources to Legal, Project Package Managers and Project Commercial Manager to prepare and negotiate claims as required.
Basic Qualifications
- Four-year degree in engineering, construction management, legal studies, business administration, or related field or equivalent combination of experience, skills, and training.
- Minimum 5 years' experience working in-house for a professional services company, preferably in engineering or construction.
- Minimum 5 years' contract management, procurement or project management experience on construction projects, ideally water infrastructure projects.
- Proven experience negotiating and creating contracts
- General experience understanding and managing cost and budgets to align with contract changes.
- Proven experience of executing and managing subcontractor and supplier agreements, ensuring compliance with insurance and bond requirements, performing term resolution negotiations with subcontractors and suppliers, as well as supplying prime contracting support.
- Possess knowledge of alternative delivery methods, including CMAR, DB, CMS and Hard Bid project delivery methods. Familiar with applicable terms and requirements of construction and related agreements.
- Ability to prioritize and work under tight timelines to meet deadlines and to shift work activities to meet immediate response needs.
- Must be detail oriented.
- Proactive and work well independently.
- Ability to manage time sensitive matters, multitask and manage competing priorities.
- Possess excellent writing/grammar/spelling skills.
- Must have a working knowledge of Microsoft Office applications including word processing, spreadsheets, and PowerPoint, as well as an aptitude for learning new database software. Advanced MS Word skills are a must.
Preferred Qualifications
- Experience working for a national commercial construction company or closely related industry preferred.
- Experience aligning cost reporting with contracting in Procurement, Project Managmeent, Cost Controls or other closely related role.
- Experience reporting on the profit and loss as a Project Manager or Assistant Project Manager or other closely related role.
