Brown & Brown is seeking a Compliance Regulatory & Legislative Strategy Attorney to join our growing team!

The Senior Director of Compliance & Regulatory Strategy serves as a premier strategic asset for the company and its public sector clients. This role provides high-level guidance on complex health & welfare and retirement plan compliance, as well as sophisticated HR issues, including leave management and employee relations. Acting as a bridge between dense regulatory requirements and practical application, the Senior Director ensures our clients navigate an increasingly litigious landscape with technical acumen and confidence. Beyond advisory and consultation, this role serves as a key "closer" in business development, elevating the company's credibility in proposal responses to RFPs and finalist meetings as a dedicated subject matter specialist. Additionally, this role serves as a dedicated liaison and "bridge" between the Brown & Brown Legal Team and the Public Sector Practice Group, as necessary.

How You Will Contribute:

  • Primary Compliance Advisor: Act as the lead legal and regulatory consultant for public-sector clients regarding employer-sponsored health and welfare plans (Medical, Dental, Vision, Life/AD&D, Disability, and Retiree coverage).
  • Federal Mandate Interpretation: Effectively and practically apply federal mandates to governmental plans, including but not limited to ACA (4980H), HIPAA, COBRA, MHPAEA, No Surprises Act (NSA), RxDC reporting, and Transparency in Coverage (TiC).
  • Public Sector Specialization: Advise on Florida-specific requirements, including Chapter 112 provisions, Sunshine Law considerations for benefits records, and public board approval processes.
  • Compliance Calendar Ownership: Manage the company's group health plan compliance calendar, with detailed information for consultant teams to support clients with compliance-related deadlines, including, but not limited to, Gag Clause Prohibition Attestations, RxDC submissions, and TiC updates in coordination with carriers and TPAs.
  • ACA Strategy: Oversee 1094/1095-C reporting strategies, variable hour determinations, and measurement period policies tailored to governmental workforces.
  • HIPAA & Privacy Leadership: Lead HIPAA Privacy/Security programs, including risk assessments, incident response coordination, and training for self-funded group health plan sponsors.
  • Training & Development: Build and deliver specialized training for HR teams, boards, and unions on evolving compliance topics and developments.
  • Toolkit Creation: Develop proprietary templates, checklists, model policies, and decision memos (e.g., HSA/HRA compliance or retiree coverage strategy).
  • Market Intelligence: Monitor federal and state legislative, regulatory, and judicial developments to publish actionable client alerts with practical implementation timelines.
  • Contractual Advocacy: Review, mark-up, negotiate, and finalize the following contracts and agreements, in collaboration with the Brown & Brown Legal team as appropriate:
  • Legal risk and commercial provisions within client services agreements,
  • HIPAA Business Associate Agreements (BAAs),
  • Third-Party Administration (TPA) and Administrative Services Only (ASO) contracts,
  • Vendor and consultant agreements, and
  • Stop-loss carrier agreements/policies.


Skills & Experience to be Successful:

  • Minimum of 10-15 years of experience in employee benefits compliance, ERISA (and non-ERISA governmental plan) law, or senior-level benefits consulting.
  • Required: Bachelor's Degree in Business Administration, Human Resources, Public Administration, or a related field.
  • Preferred: Juris Doctor (JD) or Master of Laws (LLM). While this may not be a practicing legal role, the ability to interpret statutes at a law-degree level is what provides the "technical certainty" clients expect.
  • Public Sector Focus: At least 3 years of direct experience working with governmental entities (cities, counties, school boards). This includes a working knowledge of:
  • Florida Chapter 112 (Public officers and employees).
  • Sunshine Law & Public Records compliance.
  • Governmental procurement/RFP cycles.
  • Presentation & Public Speaking: Proven track record of delivering "Summit-level" presentations or webinars to large audiences (100+ attendees).
  • Business Development: Experience participating in "finalist meetings" or oral presentations as a technical subject matter specialist to help win new business.
  • Vendor Management: Extensive experience reviewing and redlining ASO, TPA, and PBM contracts.
