Job Description Summary
The General Counsel will be responsible for providing guidance, direction and assistance in connection with a wide variety of legal matters to and on behalf of LMH Health and its subsidiaries, including a myriad of agreements as well as a broad range of health care regulatory and litigation matters. This position advises the personnel of LMH Health's and its affiliates on law matters affecting the systems' hospital, physician practices, ambulatory surgery center and other clinical and non-clinical operations. Responsibilities include a wide variety of legal assignments that require knowledge of Federal and Kansas healthcare laws and regulations, including, without limitation, the federal Anti-Kickback Statute and Physician Self-Referral Law, licensure regulations, conditions of participation, TJC standards, CMS and OIG regulations and guidance, state corporations law, general contracts law and more. Strong Transactional Experience including acquisitions and nonprofit and employment contracts. In addition, strong litigation experience would be a plus. Strategic thinker with proven problem-solving abilities. The General Counsel will be a self-motivated and highly flexible individual who is able to manage multiple tasks and priorities within a fast-paced office environment. Ability to multi-task, excellent communication skills and attention to detail are all key for this role
Responsibilities
Proactively identify legal risks affecting LMH Health and collaborate with senior management to mitigate risks.
Drive constant improvement and operational efficiency of Legal function supporting LMH Health.
Provides legal advice on proposed business arrangements.
Provides regulatory support on acquisitions, and other transactions.
Coordinates with compliance personnel to ensure compliance with applicable laws and regulations including training for the Board, management and other staff.
Appraises and keeps management informed about the impact of legislative judicial and regulatory developments affecting university policies and operations.
Reviews and approves marketing materials, advertising copy and public statements from a legal perspective.
Provides input and legal advice on business strategy, tactical plan development and implementation, and other business issues; including legal assessments, solutions-oriented risk mitigation strategies, messaging, and interactions with healthcare professionals, patients and other external parties.
Adhere to and uphold all applicable federal and state compliance regulations as well as LMH Health's Code of Conduct, and Ethical Responsibility, Compliance policies and procedures, and applicable healthcare fraud, waste and abuse laws.
Drive strategy and execution on litigation matters and potential disputes involving LMH Health.
Work cross-functionally with business teams to mitigate risk and to ensure compliance with regulatory obligations.
Be responsible for a diverse range of litigation and pre-litigation matters in a wide range of practice areas.
Provide advice and counsel to various internal clients to proactively address and resolve current and potential disputes.
Provide risk management advice while supporting LMH Health objectives.
Supervise and collaborate with outside counsel to efficiently resolve disputes and manage all aspects of outside counsel relationships.
Must be able to perform the professional and or technical competencies of the assigned department.

The position requires at least five (5) years of relevant experience practicing law, working as an in house or government lawyer or at a law firm, or any combination of the foregoing. Relevant experience includes at least two of the following substantive legal areas (preferably for clients in the health care industry): Health care Law (includes any of the following: regulatory, compliance, provider operations, physician contracting, medical foundations, payor relations, medical staff, licensure & certification, clinical trials, and medical research), corporate/governance, real estate, tax-exemption/nonprofit organizations, or complex transactions.
