Full Job Description
We are looking for a Counsel, Customer Regulatory and Resolution to join our team of professionals in Montreal. The successful candidate will manage litigated customer claims, including before the Canadian Transportation Agency, while also taking on a strong enforcement and regulatory management role, providing advice on consumer and regulatory compliance and supporting Air Canada's strategic response to regulatory and enforcement initiatives.

Responsibilities:
  • Manage and supervise consumer litigation files in Canada, including before the Canadian Transportation Agency, in collaboration with external providers, including drafting and reviewing legal proceedings.
  • Analyse legal basis of claims, analyse evidence on file, and determine defence strategy.
  • Draft court proceedings and ensure all documents are ready for production in a timely and complete fashion.
  • Review and oversee defences drafted by other lawyers and analysts.
  • Manage case timelines to ensure that all stages of the evidence gathering and defence drafting processes are followed on time.
  • In collaboration with IT, optimize the use of technology to effectively manage high volumes of litigation claims.
  • Analyse and maintain a database of successful and unsuccessful defenses in order to improve efficiency over time, as well as to improve Air Canada's overall success rate for litigated claims.
  • Identify possible efficiencies in workflows and opportunities for systemic improvements in evidence gathering and defence drafting, for discussion and review.
  • Ensure compliance with consumer and regulatory legal frameworks in Canada and in the US, identify risks and opportunities for Air Canada, and advise business units to manage regulatory and enforcement impact.
  • Support and help define Air Canada's strategic approach to new regulatory and enforcement initiatives, including drafting position statements and liaising with government officials and industry bodies to present Air Canada's position.
  • Investigate compliance verification and investigation files internally and respond to regulatory bodies as needed.

Qualifications
  • Hold a Bachelor's degree in or higher in law. Being a member of the bar in one of the Canadian provinces is an asset.
  • 2-5 years' experience in litigation and/or regulatory or enforcement matters
  • Experience in airline operation, airline management, project management, or claims management is an asset.
  • Strong organizational skills, creative and strategic.
  • Good analytical skills, ability to identify issues in workflows, develop thoughtful solutions and rally support to redefine approaches and achieve workable solutions.
  • Good written and oral communication skills, and the ability to convey messages and thoughts clearly, and concisely.
  • Enjoy working in a dynamic and constantly evolving environment alongside a very cohesive team of professionals.
  • Strong desire to participate as part of a team, to collaborate, support, empower and guide the team (when appropriate), with an ability to contribute to a shared sense of direction.
