JOB SUMMARY

The Legal Department provides strategic advice in an array of subject matters to ensure that the Lottery acts in accordance with applicable state and federal laws and regulations. The Associate General Counsel will assist the General Counsel in performing a variety of legal duties and providing the highest quality legal guidance.
ESSENTIAL FUNCTIONS
  • Contribute to the smooth daily operation of the Legal Department including assisting in the supervision of its support staff.
  • Subject to the supervision of General Counsel and/or Deputy General Counsel, provide legal advice and services to internal stakeholders pertaining to, but not limited to, Lottery regulations, policies and procedures, game rules, trademarks, procurements, and public records as well as respond to legal inquiries from external parties, including but not limited to players, their representatives, and vendors.
  • Subject to the supervision of General Counsel and/or Deputy General Counsel, represent the Lottery in hearings that may involve, but are not limited to, Compliance Department-, Licensing Department-, and/or Finance Department-related Lottery prize claim determinations and sales agent licensing actions.
  • Subject to the supervision of General Counsel and/or Deputy General Counsel, provide legal guidance to the Compliance Department and advise on investigations, interviews, review of evidence, coordination with law enforcement agencies, and other functions.
  • Subject to the supervision of General Counsel and/or Deputy General Counsel, review presentments and claims relating to motor vehicle accidents involving Lottery employees and evaluate potential resolutions.
  • Seeks approval from General Counsel and/or Deputy General Counsel in the review of court or legal orders directed to the Lottery to assure compliance; answer and file all necessary legal documents in court matters in a timely manner.
  • Seek approval from General Counsel and/or Deputy General Counsel in the legal review and facilitation of Lottery prize assignments and represent the Lottery in judicial proceedings outside the administrative process.
  • Assist General Counsel and Deputy General Counsel in coordination with private attorneys handling estates of deceased prize winners or attempting to establish acceptable trusts, and review all documents related thereto.
  • Assist the Attorney General and outside Counsel in preparing judicial cases and act as a special Assistant Attorney General in judicial proceedings as necessary.
  • Perform related duties as assigned.


Qualifications:
MINIMUM ENTRANCE REQUIREMENTS
  • Law degree from an accredited Law School and admission into the Massachusetts Bar.
PREFERRED QUALIFICATIONS
  • Comprehensive knowledge of the theory and practice of law.
  • 2-3 years' experience in a government, administrative law and/or regulatory environment, is preferred.
  • Knowledge of government regulations touching the various federal and state agencies indirectly involved in the operation of the State Lottery.
  • Ability to research law and write legal memorandums under supervision.
  • Competence in interpreting opinions of courts and rulings of administrative bodies.
  • Complete knowledge and understanding of the Lottery operations, practices, policies, and functions and the ability to apply this knowledge to work situations.
