We are seeking an attorney in the ERISA/Benefits Law Department to provide legal advice to Prudential’s retail businesses on a broad range of Employee Retirement Income Security Act (“ERISA”) and Internal Revenue Code (the “Code”) issues. The responsibilities for this position include:

  • Representing the Company’s retail business units on tax and ERISA issues resulting from the marketing and sale of insurance and annuity products to pension and IRA customers;
  • Providing tax and ERISA advice on retail product development issues for annuities, insurance, advisory accounts and on-line financial wellness services;
  • Providing design and legal advice regarding retail broker-dealer sales force compensation issues;
  • Advising on the application of the DOL Fiduciary Rule (or much lesser extent similar SEC or state law standards) to domestic business operations;
  • Collaborating with our Compliance partners on general account “Harris Trust” issues and providing legal advice on exemptions to cover the purchase of certain fixed income securities;
  • Representing a subsidiary’s benefit plans on fiduciary responsibilities, plan design and compliance issues in general;
  • Counseling on ERISA and Code disclosures in product prospectuses;
  • Collaborating with other attorneys on tax, securities, and other related regulatory matters; and
  • Providing additional legal support for special projects and other business units including Prudential’s institutional businesses.

Qualifications

  • Law degreerequired;
  • Admission to the bar of at least one state and eligibility for the NJ Corporate Counsel license if not admitted to the NJ bar;
  • At least six years of relevant ERISA/Code legal experience;
  • Superior interpersonal, organizational, written and oral communications skills and the ability to work independently and turn around documents promptly and accurately;
  • Excellent judgment and high ethical standards;
  • Strong project and time management skills; and
  • The ability to balance multiple projects simultaneously and assess and prioritize work requirements.
