Job Description

The Litigation Services Attorney job family is responsible for managing Insurance Defense and Tort Litigation / Disputes work and related issues/matters

Represents insured’s and the Company in the defense of bodily injury and property damage lawsuits, subrogation, and Allstate Financial cases. Oversees the activities of a team including attorneys, paralegals and support staff. Prepares for and conducts hearings, trials, arbitrations, mediations, and depositions. Prepares and argues pre and post-trial motions. Assists colleagues in the resolution of calendar conflicts. Provides project management, coordination, and collaboration between legal teams within L&R and with business clients. Conducts research, substantive drafting, reviewing, advising, and negotiating for more complex matters. Provides budget oversight

Key Responsibilities

• Supervise direct reports, attorneys, paralegals and administrative assistants
• Write and conduct performance reviews of team members, including checkpoints and Performance Development Summary
• Provide coaching and support to team members
• Perform quality file reviews
• Work as part of management team with Managing Attorney.
• Review new file assignments and approve initial pleadings, propound discovery, and/or develop strategy
• Contact clients to discuss their case and answer any questions
• Contact claims (initial litigation plan, recurring minimum 90 day contact, strategy conferences, etc.)
• Review all documentary evidence
• Prepare witnesses and clients for depositions, arbitrations, mediations and trials including expert witnesses
• Conduct depositions and examinations under oath and prepares summary documents
• Prepare and conduct court appearances (matter management conferences, hearings, status conferences, etc.)
• Conduct settlement/dispositive proceedings (e.g. mediations, arbitrations, etc.)
• Try and/or arbitrate cases and prepares motions in liminie and summary documents
• Draft post-trial motions
• Prepare for and participate in appeals
• Investigate and pursue subrogation litigation as appropriate
• Second chair cases with Trial Attorneys and Senior Trial Attorneys as needed.
• Monitor allocated legal expenses, track factors that drive variations, and collaborate with claims clients regarding status of contributing factors
o Administers company Human Resources policies
• Legal Advice and Counseling
o Accountable for due diligence; delegates due diligence responsibilities to Admins, Paralegals and/or other Attorneys
o Research (and lead employees who research) and determine applicable and pertinent laws, statutes, regulations, rules, and other legal authority; conducts risk analyses on key issues; relies on employees to identify and prioritize new issues
o Leverage extensive knowledge to monitor and review new laws, regulations, and case law; identify and summarize relevant issues; Collaborate with other areas of L&R department.

Job Qualifications

• Core Competencies
o Proficient skills/abilities/experiences in the following areas: legal knowledge, business knowledge, issue management, analytical skills, influencing others, coaching and development, self development, and productivity
o Advanced knowledge of professional standards, methods and concepts and the ability to direct functional strategy
• Other Requisites
o Possesses a juris doctorate; must have Texas license
o 10+ years related experience typical
o Computer skills, including MS Office suite, used in or related to the tasks performed
o Exercises discretion and maintains confidentiality of sensitive information
o Demonstrates ethics and integrity
o Has relevant experience within a reputable law firm or an in-house legal department for a mid- to large-sized organization
o Insurance-industry experience preferred
o Knowledge of legal holds and discovery processes
o Able to manage a team and work through others to complete complex projects
o Works with employees on professional development and business acumen
