Overview

The Director, Marketing Compliance will manage day-to-day marketing compliance work. Ensure all marketing assets are in compliance with current state and federal regulations and accreditor requirements. Maintain comprehensive understanding of new and existing laws and regulations that impact UOPX marketing. Maintain updated standard operating procedures and ensure marketing processes are communicated and adhered to. Maintain comprehensive understanding of required legal disclaimers and disclosures.

Responsibilities

Compliance

  • Ensure all marketing assets follow all federal, state and accreditor guidelines. Work with Apollo Legal Department, Apollo Regulatory, and UOPX Brand Management to gather requirements and oversee implementation.
  • Partner with all channels to ensure applicable regulatory and compliance guidelines are instituted and followed
  • Work with cross functional teams in Marketing, Enrollment, Finance, Product, and other business groups to update existing products and marketing materials as-needed to meet changing regulatory requirements.
  • Ensure all claims made in marketing materials are correct and verified, and do not expose the University to potential legal fines ranging from $5 million to $33 billion.
  • Serve as point of contact and marketing project lead for general internal compliance needs that are executed by the Marketing department for internal stakeholders such as Apollo Legal (ALD), Apollo Ethics and Compliance (AEC), UOPX Compliance, Office of Institutional Effectiveness, Office of Disability Services, Financial Aid Regulatory, etc.
  • Plan and conduct implementation and roll-out for programs and projects that ensure compliance in operations, product offerings, and disclosures on all marketing materials, and across all channels, including print, email, and web.
  • Perform regular audits of web, print, and all in-market materials to ensure compliance

Process

  • Determine, define and document processes for creation of marketing materials, including creation of annual operating plan, project concept through delivery, and review and approval process.
  • Ensure standards and controls in the SOP protect the University from misrepresentation risk, including ensuring that required approvals are obtained and stored in central repository; correct disclaimers are present, including GE, HLC, and TCPA; and outdated items are removed from distribution and appropriately retained and archived as required by federal or state regulations.
  • Participate on cross-functional UOPX and Apollo teams to establish new processes and redefine existing processes.
  • Communicate changes to Standard Operating Procedure and develop implementation plan. Plan and conduct quarterly new-hire training and annual legal training.

Legal/Regulatory

  • Partner with Apollo Legal Department and Apollo Ethics and Compliance, UOPX Compliance and other internal regulatory stakeholders to stay informed of pending changes to federal, state, and accreditor regulations. Including, understand all current legal disclaimers and triggers.
  • Analyze, interpret and communicate legal guidance, utilizing communications from ALD and the Legal Copywriting Guidelines for use in all marketing process, materials and external communications
  • Review marketing materials to ensure compliance with all state and federal regulations. Determine what materials need additional legal review and distribute to the appropriate legal resources for review.
  • Work with Apollo Legal Department to prepare marketing components for examinations, civil investigative demands, responses, and corrective actions including state license renewals, state attorneys general audits, Department of Education audits, State Board of Education audits, etc.
  • Liaison between ALD and UOPX Marketing to facilitate communication of marketing strategy and legal and regulatory requirements enhancing understanding between all parties involved in bringing materials to market.

Operations Systems Management

Manage all marketing systems, working independently or with our internal systems team to procure systems, develop capabilities, manage implementation and ongoing support.

Project Management

  • Oversee project managers that provide cross functional marketing program execution and tracking, including specific campaigns and enterprise-wide programs.
  • Plan and conduct implementation and roll-out for programs and projects that ensure compliance in operations, product offerings, and disclosures on all marketing materials, and across all channels, including print, email, and web.
  • Lead weekly new project and resourcing meetings to ensure collaboration and efficient use of marketing resources.

Training

  • Plan, present and conduct Annual Legal and Compliance and quarterly new hire legal and compliance trainings
  • Manage other Marketing Compliance staff

Qualifications

Basic Requirements:
• Bachelor’s degree in a job related area
• Minimum of 7 years of marketing experience
• Minimum of 8 years of experience with compliance or regulatory work

Additional Qualifications:
• MBA and/or Juris Doctor preferred
• Extreme attention to detail
• Ability to manage cross-functional team and build relationships
• Strong analytical skills and critical thinking skills
• Excellent oral and written communication skills
• Ability to communicate effectively with executive legal team and market stakeholders
