Position Purpose:


The Privacy and Corporate Counsel will assist with a variety of legal matters arising in a global retail environment with a focus on privacy policy and compliance as well as general corporate and commercial matters (including negotiation and drafting of related agreements). This person will work under the supervision of the Vice President Legal Affairs, advising on a diverse and challenging array of matters affecting the company.


Essential Job Functions: The incumbent must be able to perform all of the following duties and responsibilities w ith or without a reasonable accommodation.


  • In support of and in conjunction with Petco's Vice President Legal Affairs, provide both long-term strategic and day-to-day legal counsel , with anticipated principal focus on: (i) privacy policy and compliance; (ii) data inventory and data subject requests; (iii) commercial and corporate agreements.
  • Conduct legal analysis of the application of applicable privacy laws (state, federal and international - e.g, CCPA, GDPR) and regulations as applied to the company's business lines and subsidiaries and identifies related compliance issues.
  • Develop, support and manage Data Privacy Program, including corporate policies, operational controls and business processes to ensure compliance with applicable regulations and company philosophy.
  • Monitor and provide advice on implementation of new privacy and security laws and regulations impacting the company's business.
  • Assist in driving cross-functional organizational education of privacy awareness and proactive risk identification and assessment related to privacy as well as other enterprise-wide risk.
  • Structure, draft and negotiate agreements in support of the Company's new business initiatives and strategic transactions including mergers and acquisitions, joint ventures and collaboration agreements.
  • Consult with other members of Petco's Legal Department as well as outside counsel as necessary in providing solutions to the challenges faced by various Petco business groups.
  • Assist the Legal Department efforts in the creation, implementation and refinement of forms, policies and procedures and provide substantive support for the rest of the Legal Department on an as-needed basis.



Other Duties and Responsibilities:


Participate in special projects and perform other essential duties in accordance with subject matter expertise as assigned.


Manage outside counsel and related matter budgets.


Nature of Supervision:


Under the general direction of the Vice President Legal Affairs, the incumbent is expected to p erform ongoing legal tasks, with minimal direction and guidance, and c ollaborate with members of all departments on various projects. The incumbent is responsible for exercising discretion and independent judgment when performing job duties and must display a high degree of ethics, integrity, and professionalism.

Work Environment:


The majority of work is performed in an office environment while a small portion of time may be spent traveling in airplane and/or automobile.


Contacts:


Interaction will occur with all levels of colleagues and management, outside counsel, consultants, and regulatory agencies, in the performance of job duties. Interaction will generally entail providing advice on business and legal issues.


Qualifications


Education/Experience :


Experience in one or more of the following areas: (i) retail and/or e-Commerce business matters, (ii) mergers and acquisitions, and (iii) joint venture, partnership and strategic collaboration agreements.


J.D. from an ABA accredited law school with exceptional academic credentials and a member of a state bar in good standing


At least 8-10 years of relevant experience, including both in an in-house capacity as well as at a nationally reputable law firm as a transactional attorney.


2+ years of prior data privacy experience.
