Job Description Details

We are looking for an experienced and talented attorney to support our Zulily business, and join the larger Qurate Retail Group labor and employment team. You will be responsible for providing advice and counsel on a wide variety of employment related matters and workplace issues to Human Resources, executive management, and business clients for various business units. Additionally, this position will provide litigation management and support on employment related matters and will support the other business teams with contract review and project support as needed.

Principal duties include:


  • Provide timely and on-demand advice to HR on sensitive personnel matters related to management of employee issues such as hiring, performance management, employee misconduct, discipline, terminations, employee privacy, wage and hour, workplace investigations including investigation of internal complaints of discrimination and harassment, and employee leaves and accommodation requests
  • Advise HR and management on U.S. and global employment law-related matters, including compliance with federal, state, and local employment laws, compensation plans, Sarbanes-Oxley and Dodd-Frank whistleblower provisions, restrictive covenant protections, employment issues associated with corporate acquisitions and divestitures, diversity issues, and wage and hour compliance
  • Research, monitor and analyze any changes in federal, state, and local employment law and case decisions impacting zulily, LLC and Qurate Retail Group brands
  • Provide support for employment issues for company subsidiaries and affiliates within the Qurate Retail Group family of brands
  • Provide contract support, both for HR-related contracts (temporary labor, new systems and tools) and those outside HR when transactions involve labor and employment issues or as otherwise needed
  • Provide legal advice on risk and provide guidance and support for new HR activities and new business initiatives
  • Assist HR in creating or driving changes to policies as needed, including integration and alignment of policies where appropriate across the Qurate Retail Group brands
  • Represent the company in all dealings with employee demand letters and administrative agencies that regulate the work environment, including the EEOC and its state-level equivalents, DOL, OSHA, and other agencies; draft position statements and responses to demand letters
  • Evaluate and provide tactical and strategic advice on litigation and arbitration matters arising out of employment disputes, as well as handle employment litigation or arbitration in conjunction with outside counsel
  • Provide or coordinate proactive training to HR and/or managers re: FMLA and other leaves, ADA, anti-discrimination, harassment and retaliation reminders, whistleblower protections, dispute resolution, immigration issues, benefits, compensation, changes in the law, documentation best practices, NLRB rulings, and other labor and employment topics
  • Perform proactive audits/reviews of practices/processes—leave administration, background checks, drug and alcohol testing, I-9 form process and record keeping, wage and hour classifications, and employment related record keeping requirements
  • Direct any compliance issues to the appropriate channels for investigation and resolution
  • Collaborate with key partners to create plans to identify compliance trends and develop and implement action plans for resolution
  • Assist in drafting offer letters, employment agreements, restrictive covenants, severance/release/settlement agreements
  • Coordinate with HR/benefits on ERISA plans, annual benefits renewals and changes and advise HR on benefits issues
  • Advise on HR/ security/safety/whistleblower investigations as needed
  • Direct/manage any internal investigations needing privilege and/or coordinate with outside counsel to conduct the investigation externally
  • Work with HR to ensure consistency in practices/forms used across different office locations
  • Work with HR and the business to ensure best practices regarding protection of trade secrets and proprietary information
  • Assist HR with workers compensation claims as needed and work with HR and Facilitates on prevention of work place injuries
  • Work with HR/recruiting to streamline scalable agency/temp employee and independent contractor processes
  • Work with HR /Payroll to ensure consistency and compliance in pay practices, and assist with executive compensation, bonus programs, and equity awards
  • Advise on immigration matters (I-9 compliance, work authorizations/visa documentation)
  • Advise on talent acquisition and new hire matters
  • Assist the Ethics and Compliance team with policy education, conflict of interest issues, and other matters relating to the code of conduct
  • Assist Zulily Legal team with special projects, company initiatives and retail related legal issues as needed, including international projects

Qualifications:


  • Ideally, 7-10 years of professional experience as an employment attorney with significant direct client counseling on human resources and employee relations matters. Some in-house experience is preferred.
  • Substantial experience in Washington labor and employment laws and practices.
  • Strong attention to detail.
  • Ability to handle and strategically prioritize numerous projects in a fast-paced business environment.
  • Ability to resolve novel, complex issues with a resourceful "can-do" attitude.
  • Thoughtful and creative approach to finding business solutions for legal issues.
  • Balanced and solid judgment in ambiguous and time sensitive situations.
  • Ability to work independently with little supervision while still being able to contribute successfully to cross-functional teams.
