The General Counsel’s office is a critical component to managing the legal and administrative services of the Funds. We seek an Attorney to join this dynamic mission driven legal team to support inhouse functions including areas of tax, labor, employment, benefits, privacy, contracts, finance, non-profit business organizations, investments, board governance and trust law.
Responsibilities:
- Provide legal support on various litigation matters in federal and state courts
- Work closely with various departments, Trustees, and outside counsel
- Provide assistance in negotiation of disputes with providers and members
- Provide legal advice on commercial transactions including vendor and real estate contracts and healthcare provider agreements; review and advise staff in negotiating all contracts for the Funds
- Provide legal support on qualified plan issues for multi-employer defined Benefit Plan and single employer (in-house) Deferred Compensation plans
- Provide assistance on issues involving ERISA, COBRA, ACA, PPA, HIPAA, MHPAEA, and Internal Revenue Code
- Provide advice on issues implicating Title VII of the Civil Rights Act, NLRA, and state and local employment laws
- Provide legal support to sophisticated Finance and Investment Departments concerning assets in a variety of investment classes and instruments
- Review relevant communications to members and providers for legal issues and accuracy
- Perform additional duties, projects and responsibilities as assigned, including legal research and professional development
- Must meet performance standards including attendance and punctuality
Qualifications:
- Juris Doctorate Degree; admitted to practice in New York State required, and New Jersey preferred
- Minimum of five (5) years relevant experience
- Ability to strategize for litigation initiated against the Funds, respond timely to court deadlines, perform oral arguments at motion hearings; Excellent understanding of legal principles as they relate to federal and state court procedures
- Knowledge of ERISA and regulations affecting Taft-Hartley multi-employer benefit plans or ability to learn quickly
- Excellent writing and legal reasoning skills are essential
- Ability to work well as part of a team and interact with non-legal operational staff and outside counsel
- Superb initiative, ability and desire to work independently and assertively
- Ability to travel to courts in various counties, occasionally during the evening
- Must meet performance standards including attendance and punctuality
- Must be able to work with and communicate effectively with staff, trustees, and other professionals
- Strongly Desired: Knowledge of laws, regulations, and decisions affecting Funds’ operations; Ability to attend out of state conferences
